| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the plans received by the Local Planning Authority on 2 July 2020, (prefixed 7383-AEW-8055) 0001F, 0002F, 0003C (site plan existing), 0004H (proposed site plan), 0005B (elevations), 0006B (floor plan), 0015F (hard landscape) and 0-1640078 00 and 01 (Lighting spec and isolux plan) and in accordance with the Construction Environmental Management Plan and drawings E11-003-V01-M (play equipment), fencing, lighting and cycle stand brochures and the Customer Order Display and Canopy detail supplied 20 Aug 2020

| 3. | Ecological enhancement:
Before works other than site clearance, below ground drainage and formation of foundations is carried out further details of measures to secure ecological enhancements and a time schedule for planting, shall be submitted in writing to the Local Planning Authority and be subsequently approved. Any proposal should incorporate enhancements for biodiversity and might include green walls with plants suitable for pollinators such as ivy, honeysuckle and/or jasmine.
Any works agreed shall be conducted in accordance with the agreed scheme and retained and maintained thereafter. Any plants which die in the first five years shall be replaced to the satisfaction of the local planning authority.

| 4. | Prior to the first occupation/use of the development hereby permitted the proposed access/on-site car and cycle parking/servicing/loading/unloading/turning/waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
Reason: To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety. |
| 5. | No external lighting shall be installed other than in accordance with the lighting plan as illustrated and described on the submitted plans/design and access statement and shall not cause glare beyond the site boundaries.
Reason: In the interests of highway safety. |
| 6. | The land use hereby permitted shall not start, nor the use of the buildings commence until the remediation works proposed within the submitted Remediation Strategy and Verification Plan have been carried out to the satisfaction of the Local Planning Authority
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 7. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.

| 8. | Notwithstanding the provisions of Schedule 2, Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order) the premises shall not be permitted to be used for retail falling within Class A1 of the Schedule to the Town and Country Planning (Use Classes) Order 2005, or any revisions to the use class Order without the prior consent of the Local Planning Authority.
The reason for the condition is :-
To enable the Local Planning Authority to retain control over the use of the premises and where no retail impact study has been provided and to enable the Authority to maintain its adopted Policy which seeks to protect town centre retailing. |
| 9. | Advisory Notes
Unexploded ordnance (UXO)
We note that an assessment of unexploded ordnance (UXO) was not commissioned for this development, and whilst this Service does not challenge this, as we are not aware of WWII bombing runs over the site, or bomb hits, it would be sensible to be vigilant during any construction works that may be permitted, and be prepared to call on expert UXO advice if needed, as other parts of the current and former station site were bombed.
Advisory Note
The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems.
Construction Environmental Management Plan
Compliance with the proposed CEMP should ensure that there are no significant impacts from noise, hours or work, and waste etc.

The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future. |
