1.The Local Planning Authority considers that works associated with the creation of the vehicular access would have a detrimental impact upon the longevity and safety of the adjacent lime tree which is out the applicant's ownership and in the highway verge because of the works that are required to construct the new access would take place in close proximity to the tree and its canopy which would be within 4 metres of the stem and will reduce its life expectancy and its amenity contribution to the surrounding area. It is therefore considered by the Local Planning Authority to be contrary to Great Yarmouth Core Strategy adopted December 2015 Policies CS11 which seeks to enhance the natural environment and CS16 (criterion c) which seeks to ensure that new development does not result in adverse highway safety impacts.
2.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
