No.Condition Text
1.The proposed HMO is not considered to create high levels of amenity for future occupiers. of particular concern are Room 1, Room 5 and the ground floor kitchen. Room 1 has a single window which looks out into the shared yard / bin storage area, this is considered to create an oppressive outlook which would create a poor living environment. Room 5 has a gross floor area of 6.62 sqm which, when considering the amount of time occupants of HMOs spend in their bedrooms, is not considered to be adequate. Furthermore, the size of the ground floor kitchen is considered to be undersized. Consequently, the proposal is considered to be contrary to Core Policies CS01 (e) and CS09 (f) from the adopted Core Strategy as well as Paragraph 127 F which seek to provide high levels of amenity and healthy lifestyles for future occupiers.
2.The proposal is located next to what appears to be single family residential units and is therefore contrary to HOU23 E. Occupiers of HMOs tend to have a more intense use of private living facilities and kitchens than occupants of C3 dwellings causing additional noise and disturbance to neighbouring dwellings. No method of mitigating this disturbance has been included in the application and therefore the application is considered to be contrary to saved policy HOU23 B and F from the Borough-Wide Local Plan which seeks to protect the amenity of neighbours and the wider area.
3.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
