| 1. | The lodges would back onto Lords Lane are there is no screening proposed between the road and the lodges. This would result in an over-dominant relationship with the surrounding area which is characterised by development which is set back from the highway that is screened by at least a limited form of planting. Therefore, it is considered that the application is contrary to CS09 from the Core Strategy which seeks to ensure that developments respond to, and draw inspiration from the surrounding area's distinctive natural, built
and historic characteristics. |
| 2. | The lodges are proposed to be situated alongside the protected trees. There has been a lack of information provided about how the trees would be protected during the construction of the lodges and therefore the Local Planning Authority cannot be certain that the proposal would not harm the protected trees. Consequently, it is considered that the application is contrary to core policy CS09 which seeks to ensure that all new development takes measures to avoid or reduce adverse impacts on existing biodiversity assets. |
| 3. | The application site is located within the 400m to 2.5km Orange Indicative Habitat Impact Zone although there has not been a shadow HRA provided as part of this application. Moreover, the required HMMS payment has also not been paid. As such the Local Planning Authority cannot fully assess the additional impact upon the Natura2000 sites within the Borough, nor can it be certain that it will be able to secure the appropriate mitigation. Consequently, the application is contrary with Core Policy CS11 from the adopted Core Strategy. |
| 4. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
