1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development hereby permitted shall be carried out in accordance with the submitted application form received on 3 March 2020 and revised drawing numbers: 644.4B and 644.4C received on 17 July 2020 by the Local Planning Authority and shall be retained in the approved form thereafter. No material variation from these plans shall take place unless otherwise first agreed in writing with the Local Planning Authority.
The reason for the condition is :-
In order that the development hereby permitted shall be fully implemented in complete accordance with the approved plans and to accord with the Great Yarmouth Borough-Wide Local Plan. |
3. | The developments hereby permitted shall be constructed in soft red bricks laid in lime mortar with a brick bond including snapped headers to ensure that vernacular materials and approaches are used as far as practicable within the setting of the listed barn

In the interest of the character and amenity of the listed building in accordance with the Great Yarmouth Borough-Wide Local Plan |
4. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) the dwellings shall not be extended in any way without the prior consent of the Local Planning Authority.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity. |
5. | Prior to the commencement of construction works, tree protection measures ( protective fencing) shall be erected to protect the trees and their canopies beyond the site's front boundary along Main Road in accordance with Tree Preservation Order No. 16/2019 and retained intact for the full duration of the development hereby approved and shall not be removed or repositioned without the prior written approval of the Local Planning Authority. The protective measures shall be implemented without causing an impact on pedestrians and highway safety.
The reason for the condition is :-
To ensure the continued well being of the trees in the interests of the amenity and environmental quality of the locality |
6. | Prior to the commencement of the use hereby permitted the vehicular access shall be re-graded such that the gradient shall not exceed 1:12 for the first 5 metres into the site as measured from the near channel edge of the adjacent carriageway and widened/maintained to a minimum width of 5 metres over that said distance. The access shall be constructed in accordance with the Norfolk County Council residential access construction specification. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway.
The reason for the condition is: -
To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway interests of highway safety and traffic movement. |
7. | Prior to the first occupation of the development hereby permitted visibility splays shall be provided in full accordance with the details indicated on the approved plan Dwg No.644.1B (namely 2.4 metres X 59 metres and 2.4 metres x 43 metres to the east and west of the access respectively). The splay(s) shall thereafter be maintained at all times free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway.
The reason for the condition is: -
In the interests of highway safety in accordance with the principles of the NPPF. |
8. | Prior to the first occupation of the developments hereby permitted the proposed access, on-site car and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is: -
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety. |
9. | Construction work shall not take place outside the following hours:-
08:00 to 18:00 Monday to Friday,
08:30 to 13:30 Saturday
No work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property).
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
10. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposals meet the criteria for new housing development set out in Policies CS2, CS3, CS9, CS10, CS11, CS14 and CS16 of the Great Yarmouth Core Strategy, paragraphs( 2, 7, 8, 11, 48, 55, 59, 76, 109, 170, 177 200) of The National Planning Policy Framework (NPPF) and The Planning (Listed Buildings and Conservation Areas) Act 1990 (Section 72). |
11. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017.
In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy. |
