| 1. | The proposed use is incompatible with the existing uses within the defined group of shops and services and cannot be adequately conditioned to mitigate against the adverse effects that future occupants would be exposed to. The exceptionally close proximity to two late night food takeaways and a public house with associated extraction, ventilation and customers would result in complaints about the established businesses by way of future occupants suffering unacceptable nuisance by way of both noise and odour. It is therefore considered that the application is contrary to paragraph 127 (f) from the National Planning Policy Framework and Core Policies CS07 and CS09 (f) which seek to ensure high levels of amenity for future occupiers and to ensure that any use within the local centres are compatable with the existing uses. |
| 2. | The additional car movements across private land to the rear parking area will have an unacceptable adverse impact on the adjoining dwellings by virtue of increased noise levels owing to the close proximity of the drive to the existing residential properties. It is therefore considered that the application is contrary to saved policy HOU07 (e) from the Borough-Wide Local Plan and core policy CS09 (f) from the adopted core strategy which seeks to protect the amenity of neighbouring residents. |
| 3. | As no phase 1 contamination report has been received, the applicant has not adequately demonstrated that the proposed development is free of contamination or capable of remediation. As it is likely that there is a level of pollutants, including hydrocarbon contamination, the application is contrary to current local and national planning policy with specific reference National Planning Policy Framework paragraph 179 and policy CS9 of the Great Yarmouth Core Strategy. |
| 4. | The proposed works to the exterior of the building, including the removal of the chimney and alterations to the elevations, would erode the character of the building and consequently would have a detrimental impact upon the significance of the Conservation Area. It is therefore considered contrary to paragraph 185 of the National Planning Policy Framework and core policy CS10 from the adopted Core Strategy which seek to conserve and enhancing the significance of the borough's heritage assets. |
| 5. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
