| 1. | The application site is located within Flood Zone 3A as shown on the Environment Agency potential risk of flooding maps and proposes a more vulnerable, residential use. In the absence of the measures requested by the Environment Agency (ie the raising of finished floor levels) to a safe level, the Local Planning Authority is unwilling to accept the risk to future occupants as it considers that it has not demonstrated that this more vulnerable use would to be safe for the lifetime of the development and is unacceptable on grounds of increased flood risk. In the absence of such information it is not considered that the proposal passes the sequential test and subsequently the exceptions test as required by local policy and national planning guidance. As a consequence the local planning authority considers that the application does not comply with Core Policy CS13 of the Great Yarmouth Local Plan adopted 2015 and fails to meet the requirements of Paragraphs 155 and 158 of the National Planning Policy Framework. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
