| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans (plan ref: RM/19/294 01) received by the Local Planning Authority on the 23rd December 2019.
The reason for the condition is:-
For the avoidance of doubt. |
| 3. | Any access gates/bollard/chain/other means of obstruction shall be hung to open inwards, set back, and thereafter retained a minimum distance of 5 metres from the near channel edge of the adjacent carriageway. Any sidewalls/fences/hedges adjacent to the access shall be splayed at an angle of 45 degrees from each of the outside gateposts to the front boundary of the site
The reason for the condition is :-
In the interests of highway safety enabling vehicles to safely draw off the highway before the gates/obstruction is opened. |
| 4. | Prior to the occupation of the development hereby permitted the vehicular access indicated for improvement on Drawing No. RM/19/294 01 shall be upgraded in accordance with the Norfolk County Council residential access construction specification (TRAD 5 attached) for the first 5.0 metres as measured back from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway.
The reason for the condition is :-
To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety and traffic movement. |
| 5. | Prior to the first occupation of the development hereby permitted a 2.4 metre wide x side extents (including the flank frontage of the adjacent property as outlined in blue on the submitted details) shall be provided to each side of the access where it meets the highway.
The splays shall thereafter be maintained at all times free from any obstruction exceeding 1.05 metres above the level of the adjacent highway carriageway.
The reason for the condition is :-
In the interests of highway safety in accordance with the principles of the NPPF. |
| 6. | Prior to the first occupation of the development hereby permitted the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/ manoeuvring areas, in the interests of satisfactory development and highway safety. |
| 7. | Construction work shall not take place outside the following hours:-
07:30 to 18:00 Mondays
07:30 to 18:00 Tuesdays
07:30 to 18:00 Wednesdays
07:30 to 18:00 Thursdays
07:30 to 18:00 Fridays
08:00 to 13:00 Saturdays
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 8. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 9. | Notwithstanding the approved details, no external lighting is to be installed without the prior consent of the Local Planning Authority. Details shall include the types of light appearance, position, illumination levels and light spillage.
The reason for the condition is:-
To ensure that any impact on bats or other European protected species is sufficiently mitigated. |
| 10. | Prior to the first occupation of the dwelling hereby approved, the four bird and two bat boxes, as detailed in Section 5.1.3 of the report (Ecocheck, 2020) shall be installed. The installation of the bird and bat boxes shall be overseen by a suitably qualified ecologist. A letter from them, with photos, detailing the location and date of the completion submitted to and approved in writing by the Local Planning Authority.

| 11. | Occasionally European Protected Species, such as bats, can be found during the course of development even when the site appears unlikely to support them or after an ecological survey has found no previous evidence of them. In the case that this occurs, the development works shall stop immediately and the developer shall seek the advice of a suitably qualified ecological consultant.
The reason for the condition is :-
To protect any European protect species that may be on the site. |
| 12. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting the order) no extensions shall be built or any windows inserted into the walls or roof of the building(s), other than those approved as part of this application, without the prior consent of the Local Planning Authority.
The reason for the condition is:-
In the interests of the residential amenities of the occupiers of the adjacent property. |
| 13. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria set out in saved policies HOU07 and BNV21 from the Borough-Wide Local Plan and core policy CS09 from the adopted Core Strategy. |
| 14. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017.
In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy. |
| 15. | NOTES - Please read the following notes carefully:-
The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. Trees and scrub are likely to contain nesting birds between 1st March and 31st August inclusive. In addition the building has been found to contain evidence of nesting birds. These habitats are assumed to contain nesting birds between the above dates, unless a recent survey has been undertaken by a competent ecologist to assess the nesting bird activity on site during this period and has shown it is absolutely certain that nesting birds are not present. |
| 16. | NOTES - Please read the following notes carefully:-
The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed: -
- An adequate supply of water shall be available for suppressing dust;
- Mechanical cutting equipment with integral dust suppression should be used;
- There shall be no burning of any materials on site. |
