| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans (plan ref: W506-LOC01, W506 PL05, W506 PL08, W506 PL02,W506 PL04) and the materials schedule (Materials Schedule Rev.A, prepared by Wellington) received by the Local Planning Authority on the 8th June 2020 and the revised plan (plan ref: 2441-19 rev 4) received by the Local Planning Authority on 20th January 2020 and the revised plan (Plan ref: RLC-00-00-DR C-001 rev P3) received by the Local Planning Authority on the 11th February 2020 and the revised plan (plan ref: W506 PL07 rev A) received by the Local Planning Authority on the 23rd March 2020 and the revised plan (plan ref: W506-PL01 Rev F and W506 PL06 rev A) received by the Borough-Council on the 25th March 2020 unless otherwise agreed in writing and the revised plan (plan ref: W506-PL03 Rev A) received on the 3rd November 2020.

| 3. | No works shall commence on the site until such time as detailed plans of the roads, footways, street lighting, foul and surface water drainage have been submitted to and approved in writing by the Local Planning Authority. All construction works shall be carried out in accordance with the approved plans.
Reason:
This needs to be a pre-commencement condition to ensure fundamental elements of the development that cannot be retrospectively designed and built are planned for at the earliest possible stage in the development and therefore will not lead to expensive remedial action and adversely impact on the viability of the development. |
| 4. | Prior to the occupation of the final dwelling all works shall be carried out on roads/footways/street lighting/foul and surface water sewers in accordance with the approved specification to the satisfaction of the Local Planning Authority.
Reason:
To ensure satisfactory development of the site and to ensure estate roads are constructed to a standard suitable for adoption as public highway. |
| 5. | Before any dwelling is first occupied the road(s)/footway(s) shall be constructed to binder course surfacing level from the dwelling to the adjoining County road in accordance with the details to be approved in writing by the Local Planning Authority.
Reason:
To ensure satisfactory development of the site. |
| 6. | Development shall not commence until a scheme detailing provision for on-site parking for construction workers, temporary wheel washing & access arrangements for delivery vehicles for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period.
Reason:
To ensure adequate off-street parking during construction in the interests of highway safety. This needs to be a pre-commencement condition as it deals with the construction period of the development. |
| 7. | Notwithstanding the details indicated on the submitted drawings no works above slab level shall commence on site unless otherwise agreed in writing until detailed drawings for the off-site highway improvement works as indicated on Drawing no. W506-HWY-01 (or an alternative plan agreed in writing with the Council) have been submitted to and approved in writing by the Local Planning Authority.
Reason:
To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor. |
| 8. | Prior to the first occupation of the development hereby permitted the off-site highway improvement works (including Public Rights of Way works) referred to in Condition 7 of this condition shall be completed to the written satisfaction of the Local Planning Authority.
Reason:
To ensure that the highway network is adequate to cater for the development proposed. |
| 9. | The residential development hereby granted planning permission shall be wholly located within and limited to the land outlined in red, totalling 1.42 hectares, in accordance with the site layout plan (plan reference: W506-LOC01) received by the Local Planning Authority on the 14th November 2019 and for a maximum of 46 dwellings.

For the avoidance of doubt and in accordance with the application details. |
| 10. | Prior to commencement of development the works outlined in Section 6 of the approved archaeological written scheme of investigation submitted with this planning application ('Written Scheme of Investigation for Post-Determination Trial Trenching: Land at Repps Road, Martham, Norfolk', 2019, RPS Group) and any subsequent addenda to that document shall be carried out.

| 11. | The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the archaeological written scheme of investigation approved under condition 10 and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured.
The reason for the condition is :-

| 12. | Construction work shall not take place outside the following hours:-
08:00 to 18:00 Mondays
08:00 to 18:00 Tuesdays
08:00 to 18:00 Wednesdays
08:00 to 18:00 Thursdays
08:00 to 18:00 Fridays
08:30 to 13:30 Saturdays
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 13. | Prior to the commencement of the development hereby approved site levels, including a cross section of the site showing land levels as existing and as proposed shall be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved plans.
The reason for the condition is :-
In order to retain control over any significant changes in levels within the site. |
| 14. | No works shall commence on the construction of the dwellings until such a time as details of the slab levels of the dwellings in relation to the proposed ground levels on site and existing levels at the land immediately adjacent the site have been submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved plans.
The reason for the condition is:-
To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site. |
| 15. | Prior to the importation of any soil to the site the amount and source of topsoil shall be submitted to and approved by the Local Planning Authority. The topsoil shall be demonstrably clean and from a certified source. Only topsoil approved by the Local Planning Authority shall be imported onto the site.
The reason for the condition is :-
To ensure an adequate form of development. |
| 16. | All planting, seeding or turfing comprised in the approved details of landscaping (plan ref: 2441-19 rev 4) shall be carried out within 9 months of the occupation of the dwelling on any plot to which the planning, seeding or turfing relate. Any planting, seeding or turfing comprised in the approved details of landscaping that do not relate to a dwelling shall be carried out prior to the occupation of the 30th dwelling hereby approved. Any trees or plants which, within a period of 5 years from the occupation of the final dwelling of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

| 17. | Prior to the first occuaption, a 'lighting design strategy for biodiversity' shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall:
a) Identify those areas/features on the site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites and resting places or along important routes used to access key areas of their territory, for example foraging, and
b) Show how and where external lighting will be installed (through provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent the above species using their territory or having access to breeding sites, resting places or feeding areas.
All external lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without the prior consent of the Local Planning Authority.

To minimise and mitigate for potential impacts on bats. |
| 18. | No work above ground level shall commence until the full details of the height and materials of all boundary treatments, including any means of enclosure between the dwellings and the highway/driveway onto which they front shall be submitted for the approval, in writing, of the Local Planning Authority and no dwelling shall be first occupied until that means of enclosure has been provided in accordance with the approved details.

| 19. | All ecological measures and/or works shall be carried out in accordance with the details contained in the NWS Ecological Report - Land South of Repps Road, Martham dated 04/05/2020 (Amendments V1) as already submitted with the planning application and agreed in principle with the local planning authority.
The reason for the condition is :-
To secure habitat enhancement and biodiversity gain, in accordance with the NPPF. |
| 20. | No more than 46 properties shall have access to or egress from the site from Rising Way and no other vehicular accesses may be formed to the site without the written consent of the Local Planning Authority. There shall be no vehicular access to the land beyond from the land included within the red line on plan W506-PL01-Rev F received by the Local Planning Authority on the 25th March 2020.
The reason for the condition is:-
To ensure that the accesses for the development are provided in the manner applied for and for the avoidance of doubt. |
| 21. | The access shown to Merriman Road shall be a pedestrian access only and shall not be utilised as access or egress for vehicles in accordance with the revised site layout plan (plan ref: W506-PL01 rev F) received by the Local Planning Authority on the 25th March 2020.
The reason for the condition is:-
For the avoidance of doubt. |
| 22. | Development shall be carried out in accordance with the Rossi Long Flood Risk and Surface Water Drainage Strategy (Rev 01, December 2019), or any alternative surface water drainage strategy agreed in writing by the Local Planning Authority.
The reason for the condition is :-
To prevent environmental amenity problems arising from flooding. |
| 23. | All work within the Tree Root Protection Area, as detailed in the 'Arboricultural Method Statement and Tree Protection Plan for: Land off Repps Rd, Martham' received by the Local Planning Authority on the 14 November 2020, shall be carried out in accordance with BS5837 standards and shall follow the recommendations contained within the report.
The reason for the condition is :-
In the interests of protecting trees in the vicinity of the development. |
| 24. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria set out in core policy CS02 from the adopted Core Strategy. |
| 25. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
| 26. | NOTES - Please read the following notes carefully:-
In accordance with section 10 of the contaminated land report conducted by the Norfolk Partnership Laboratory, the following recommendations must be adhered to:
There is topsoil on site. It is recommended that this material is stripped and stockpiled during the clearance phase. This stockpiled material can then be inspected to determine if the material is as seen during the site investigation. Analysis has already confirmed its suitablity for re-use in the garden areas upon completion. Once the topsoil has been stripped, it is recommended that a competent person from Norfolk Partnership Laboratories visits the site to ensure that no visible or olfactory signs of contamination are present in the area of WS17. The material will be inspected and further samples will be taken and tested for Lead. A record will be kept of all findings and will be submitted within a valid report. It should also be stressed that if any possible contaminated materials should be found during the site clearance or the construction processes then Great Yarmouth Borough Council and Norfolk Partnership Laboratory should be informed immediately. |
| 27. | NOTES - Please read the following notes carefully:-
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. This development involves work to the public highway that can only be undertaken within the scope of a Legal Agreement between the
Applicant and the County Council. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council's Highways Development Management Group based at County Hall in Norwich.
Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. If required, street furniture will need to be re-positioned at the Applicants own expense. Street lighting is a concurrent power of the County, District and Parish Councils. However, it is the County Council after consultation with the Local Lighting Authority (District or Parish Council) who decides whether street lighting is required on proposed public highways. Norfolk County Council will challenge any automatic assumption that street lighting needs to be provided on part or all of the new development.
In this case the programme of archaeological mitigatory work will commence with informative trial trenching to determine the scope and extent of any further mitigatory work that may be required (e.g. preservation by design, archaeological excavation or monitoring of groundworks during
construction). A brief for the archaeological work can be obtained from Norfolk County Council Historic Environment Service. We advise that the trial trenching is carried out at an early stage in the preparation of the reserved matters details so that the results can be fully considered in the design process. |
| 28. | NOTES - Please read the following notes carefully:-
The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird whilst the nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. Trees and scrub are likely to contain nesting birds between the 1st March and 31st August inclusive. Trees and scrub are present ton the application site and are therefore assumed to contain nesting birds between the above dates, unless a recent survey has been undertaken by a competent ecologist to assess the nesting birds are not present. Cut vegetation is to be wither removed from site or chipped. Piles of brash are not to be stored on site as this provides potential nesting habitat for birds. If piles of brash are left on site during the main breeding season these will need to be inspected for active nests prior to removal. |
