| 1. | The property is located within the Back of the Seafront Improvement Zone and emerging policies GY7 and H12 from the final draft LPP2 state that the Council will resist HMOs in this area due to concerns about this type of accommodation having an adverse impact on the character of the area. The proposal is for a 7 bedroom sui generis HMO and this use has the potential to harm the character of the area which is predominantly made up of guest houses, hotels and residential flats. The application is therefore also contrary to Saved Policy HOU23 B from the Borough-Wide Local Plan. |
| 2. | Bedroom 7 has a total floor area of 5.72sqm which falls below the minimum size standards outlined in emerging policy H12 from the final draft of the LPP2. This would lead to an oppressive living environment for occupiers of this room, especially when considering residents of a HMO tend to spend a greater period of time in their private space. The proposal is therefore contrary to Core Policy CS09 F which seeks to protect the amenity of existing and future residents. |
| 3. | The information submitted as part of this application was inconsistent and limited. Therefore, due to a lack of detail, it is not possible to be sure what the intended layout is and consequently it is not possible to condition the use in accordance with the plans. |
| 4. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
