No.Condition Text
.Plot 1 would cause unacceptable overshadowing to the existing garden of no.23 Crab Lane. Plots 1 and 2 are out of keeping with the character of the area by being disproportionately deep and bulky compared to nearby dwellings and would have notably less articulation of form than other dwellings in the vicinity contrary to saved policies HOU7 and HOU17 of the Borough Wide Local Plan and policy CS9 of the Core Strategy.
.The positioning of plots 5 and 6 is out of keeping with the character and built form of the area. The parking areas located to the eastern boundary of the site will adversely impact the living conditions of the occupiers of the dwellings to the east, Hedignton Way, by way of headlights, noise and disturbance by people and vehicles. Plot 6 is of an excessive height with a disproportionate roof which is detrimental to the quality of design, is out of keeping with the area and is excessive in scale, the development is contrary to saved policies HOU7 and HOU17 of the Borough Wide Local Plan.
.The spread and scale of the development would be unreflective of the established development pattern and would also appear cramped within the site. This would represent over-development which would be detrimental to the character and appearance of the area contrary to saved policy HOU17 of the Borough Wide Local Plan.
.The application seeks to remove two trees protected by tree preservation order and is more likely than not to result in the loss of the third by the inappropriate design and over development of the site. The replanting identified with in the report is lacking in thought and detail with no plan nor information on projected size and value to the character of the area. The plans submitted only indicate indicative planting, insufficient information has been provided to state that a condition could be complied with to compel replanting of the trees proposed. There is insufficient space remaining to plant trees that would compensate for the loss of the mature trees proposed to be removed. The removal of the trees would be to the detriment of the visual amenity of the locality. There is no evidence submitted to justify the removal of the trees submitted in support of the application and as such the development would be contrary to Policy CS9 of the Core Strategy which requires development to conserve and enhance landscape features and townscape quality.
.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
