1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans (plan refs. 8077 P01, 8077 P03 A), application forms, Design and Access statement and Proposed Lighting Addendum received by the Local Planning Authority on the 9th October 2019. The reason for the condition is:- For the avoidance of doubt.
3.Notwithstanding the approved information, no external lighting is to be installed without the prior consent of the Local Planning Authority. The reason for the condition is :- In the interests of protecting neighbouring amenity.
4.The development shall be carried out in accordance with the information and recommendations provided in the Adrian James Acoustics Ltd Technical Report Received by the Borough Council on the 24th January 2020. The reason for the condition is :- In the interests of protecting neighbouring amenity.
5.Prior to the first use of the outdoor screen, an audio level limiter shall be installed and the limiter thresholds shall be submitted to and agreed in writing by the Local Planning Authority and shall remain as such thereafter. The limiter thresholds should be set with reference to sound measurements taken at 10 metres from the main loudspeakers. Amplified sound levels should be checked at the boundaries with the nearest residential properties. The reason for the condition is :- In the interests of protecting neighbouring amenity from unacceptable levels of noise pollution.
6.Use of the outdoor screen / stage shall not take place outside of the following hours:- 11:00 to 22:00 Monday 11:00 to 22:00 Tuesday 11:00 to 22:00 Wednesday 11:00 to 22:00 Thursday 11:00 to 22:00 Friday 11:00 to 22:00 Saturday 12:00 to 22:00 Sundays. (These hours shall only apply to noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
7.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the aims set out in core policy CS08 from the adopted Core Strategy.
