1.The development must be begun not later than 3 years beginning with the date of this permission. The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the plans reference: G2766 AL(0) 003 Rev 4 G2766 AL(0) 004 Rev 1 G2766 AL(0) 005 Rev 1 G2766 AL(0) 006 Rev 2 G2766 AL(0) 007 Rev 2 Received by the Local Planning Authority on the 20th September 2019 and the accompanying supporting information received on the same day. The reason for the condition is :- For the avoidance of doubt.
3.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
4.Prior to the first use of the development hereby permitted the proposed access/on-site car and cycle parking/servicing/loading/unloading/turning/waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/ manoeuvring areas, in the interests of satisfactory development and highway safety.
5.Prior to first use of the development hereby permitted a scheme for the parking of cycles shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose. The reason for the condition is :- To ensure the provision of adequate cycle parking that meets the needs of occupiers of the proposed development and in the interests of encouraging the use of sustainable modes of transport.
6.Prior to the commencement of the use a monitoring programme to assess the level of traffic generation at defined intervals of on street parking on Thamsfield Way resulting from the development shall be submitted to and approved in writing by the Local Planning Authority in consultation with Norfolk County Council as the local highway authority. The monitoring programme shall be implemented as agreed unless the Local Planning Authority gives written approval to any variation in consultation with Norfolk County Council, the local highway authority. The reason for the condition is :- To ensure that agreed parking levels are not breached and the highway network is adequate to cater for the development proposed.
7.At the expiration of a 12 month monitoring period the applicant shall submit the report and results of the approved monitoring programme to the Local Planning Authority who, in consultation with the Highway Authority, will determine the need for a Traffic Regulation Order(s). If required by the Local Planning Authority in association with the Highway Authority, within 18 months of the use commencing a Traffic Regulation Order(s) shall be promoted by the Highway Authority for parking/loading restrictions. The reason for the condition is :- To ensure that agreed traffic levels are not breached and the highway network is adequate to cater for the development proposed.
8.Prior to the commencement of the use of the use details of a flood evacuation plan and response plan shall be submitted to and approved by the Local Planning Authority. The reason for the condition is :- To ensure that appropriate staff are signed up to flood alerts and warnings and that all users of the site are aware of the procedure to be undertaken in the event of a flood.
9.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
10.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in Policy CS7 of the Great Yarmouth Core Strategy.
