1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the revised package of plans received by the Local Planning Authority on 3rd April 2020.
The reason for the condition is :- For the avoidance of doubt. |
3. | This application here approved is for the change of use of a workshop and gallery falling primarily within Class B1 of the Use Class order to a mixed live/work use of sui generis nature and notwithstanding the provisions of Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order) the premises shall not be permitted to be subdivided to become a separate B1 unit and residential dwellinghouse.
The reason for the condition is :- The case is made for this development partly in areas at higher flood risk in that the sequential test is passed because the approval is for live work use and where this enables the continued beneficial use of the heritage asset. |
4. | Should works not foreseen arise as a result of the requirements of the building regulations with particular reference to reinforcement of the existing ground slab or the provision of foundations not shown on the plan further application formally or informally shall be made to the local planning authority for these works. Any agreed works shall be conducted in the agreed manner, retained and maintained thereafter.
Reason: This is a highly sensitive historic site where ground disturbance not foreseen will require referral to the County Archaeologist, and additional works will require specialist historic building advice. Some conceivable changes might have flood resilience implications. |
5. | Any works of repair to the existing windows and doors shall use materials, techniques, details and finishes to replicate the existing fabric. All rainwater goods and any external soil pipes where replaced shall be in either cast iron, painted black.

6. | Before the works are completed 5 bird boxes shall be provided for House Sparrows with the entrance hole where possible facing north-east and is sheltered from the prevailing wind and rain, positioned 2.0m above ground.
The reason for the condition is :- in accordance with GYBC's Policy CS11 Enhancing the Natural Environment, and the NPPF, measures to appropriately contribute to the creation of biodiversity features should be included. |
7. | NOTES - Please read the following notes carefully:
Informative: Protected species "Occasionally European protected species, such as bats can be found during the course of development even when the site appears unlikely to support them or after an ecological survey has found no previous evidence of them. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitability qualified ecological consultant."
Informative: Nesting Birds
"The applicant is reminded that under the Wildlife and Countryside Act 1981 as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. The building may likely to contain nesting birds between 1st March and 31st August inclusive unless a recent survey has been undertaken by a competent person to assess the nesting bird activity on site during this period and has shown it is absolutely certain that nesting birds are not present." |
