| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans (plan refs. 8041 P.04, 8041 P08, 8041 P.01 REV C, 8041 P.03, 8041 P09, 8041 P05, 8041 P06, 8041 P07 and 8041 P.02 REV C) received by the Local Planning Authority on the 8 July 2019 and with the following revised plan (plan ref. 8041 P.02 D) received by the Local Planning Authority on the 7 January 2020.

| 3. | Prior to the commencement of the development, detailed designs of the surface water drainage scheme incorporating the following measures shall be submitted to and agreed with the Local Planning Authority. The scheme shall address the following matters:
- Revised Surface Water Drainage plans showing the additional development areas;
- Revised calculations to include the additional impermeable areas proposed in the new application:
Detailed designs, modelling calculations and plans of the drainage conveyance network in the:
- 3.33% annual probability critical rainfall event to show no above flooding on any part of the site.
- 1% annual probability critical rainfall plus climate change event to show, if any, depth, volume and storage location of any above ground flooding from the drainage network ensuring that flooding does not occur in any part of a building or any plant susceptible to water (e.g. pumping station or electricity substation) within the development.
The reason for the condition is :-
To prevent flooding in accordance with National Planning Policy Framework paragraphs 163, 165 and 170 by ensuring the satisfactory management of local sources of flooding surface water flow paths, storage and disposal of surface water from the site in a range of rainfall events and ensuring the SuDS proposed operates as designed for the lifetime of the development. |
| 4. | Prior to the first use of the car park hereby permitted (as shown on drawing 8041 P.03) a 2.4 metre parallel visibility splay (as measured back from the near edge of the adjacent highway carriageway) shall be provided across the whole of the site's roadside frontage.
The splay shall thereafter be maintained at all times free from any obstruction exceeding 0.6 metres above the level of the adjacent highway carriageway.
The reason for the condition is :-
In the interests of highway safety in accordance with the principles of the NPPF. |
| 5. | Prior to the first use of the development hereby permitted the proposed access on-site car and turning areas shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/ manoeuvring areas, in the interests of satisfactory development and highway safety. |
| 6. | The accommodation hereby approved shall be used for holiday occupancy only and shall at no time be utilised as permanent residential living accommodation.
The reason for the condition is:-
For the avoidance of doubt. |
| 7. | The new units of holiday accommodation hereby approved shall only be occupied for holiday purposes and shall not be occupied during the period from the 14th January to the 1st March in any year.
The reason for the condition is:-
To ensure that the units of holiday accommodation do not become permanent residential accommodation and to tie in with other recently approved holiday accommodation on the same site. |
| 8. | Notwithstanding the approved details, no external lighting is to be installed without the prior consent of the Local Planning Authority in consultation with Environmental Health. Details shall include the types of light appearance, position, illumination levels and light spillage.
The reason for the condition is:-
To ensure that the levels of external lighting do not adversely affect the amenities and character of the area. |
| 9. | All work within the Tree Root Protection Area, as detailed in plan 8041 P.02 D received by the Local Planning Authority on the 7 January 2020, shall be carried out in accordance with BS5837 standards.
The reason for the condition is :-
In the interests of protecting trees in the vicinity of the development. |
| 10. | The caravans and lodges are to be single storey only.
The reason for the condition is:-
For the avoidance of doubt. |
| 11. | Notwithstanding the submitted details, no external extraction is to be installed at the facilities building without the prior consent of the Local Planning Authority.
The reason for the condition is :-
To ensure that the odour does not escape the site and adversely effect the amenities of nearby residential properties. |
| 12. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria set out in core policies CS01, CS02 and CS08 from the adopted Core Strategy and with saved policies TR11, TR15 and TR16 from the Borough-Wide Local Plan. |
| 13. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
| 14. | NOTES - Please read the following notes carefully:-
Anglian Water has assets close to or crossing this site or there are assets subject to an adoption agreement. Therefore the site layout should take this into account and accommodate those assets within either prospectively adoptable highways or public open space. If this is not practicable then the sewers will need to be diverted at the developers cost under Section 185 of the Water Industry Act 1991, or in the case of apparatus under an adoption agreement , liaise with the owners of the apparatus. It should be noted that the diversion works should normally be completed before development can commence. |
| 15. | NOTES - Please read the following notes carefully:-
(1) INFORMATIVE - Notification of intention to connect to the public sewer under S106 of the Water Industry Act Approval and consent will be required by Anglian Water, under the Water Industry Act 1991. Contact Development Services Team 0345 606 6087.
(2) INFORMATIVE - Protection of existing assets - A public sewer is shown on record plans with the land identified for the proposed development. It appears that development proposals will affect existing public sewers. It is recommended that the applicant contacts Anglian Water Development Services Team for further advice on this matter. Building over existing public sewers will not be permitted (without agreement) from Anglian Water.
(3) INFORMATIVE - Building near to a public sewer - No building will be permitted within the statutory easement width of 3 metres from the pipeline without agreement from Anglian Water. Please contact Development Services Team on 0345 606 6087.
(4) INFORMATIVE - The developer should note that the site drainage details submitted have not been approved for the purposed of adoption. If the developer wishes to have the sewers in a sewer adopted agreement with Anglian Water (under Sections 104 of the Water Industry Act 1991), they should contact our Development Services Team on 0345 606 6087 at the earliest opportunity. Sewers intended for adoption should be designed and constructed in accordance with Sewers for Adoption guide for developers, as supplemented by Anglian Water's requirements |
