1.The application requires, given its location in relation to a European Designated Site, a Shadow Habitat Assessment. No Assessment has been provided and as such there is insufficient information to determine the impact of the development on the European Designated Site. In the absence of the required information the possibility that the development would have adverse effects on the integrity of the designated site, either alone or in combination with other planned development cannot be ruled out. In these circumstances, having regard to the Habitats Regulations, planning permission should not be granted unless an Appropriate Assessment. has been undertaken to assess the likely effects.
2.The application site is insufficient to provide adequate parking, living and amenity standards for future occupiers and as such is contrary to policy CS9 of the Core Strategy, saved policy HOU7 of the Borough Wide Local Plan and paragraphs 124 and 127 of the National Planning Policy Framework.
3.The development would lead to a density of residential development out of character with the existing area and would decrease the amenity space of the donor dwelling to an unacceptable level in comparison with the scale and character of the area and should be refused in accordance with saved policy HOU17 of the Borough Wide Local Plan.
4.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
