No.Condition Text
1.The applicant has failed to demonstrate that there is sufficient land within the application site to show that the highway can be accessed without creating the need for additional safe accesses . The application does not include details of any additional accesses. There is no space shown within the application area for parking or turning of visitors or employees to comply with Norfolk County Council standards and it is therefore assessed that this cannot be provided. The lack of parking and turning areas on site could cause an overspill of traffic and parking to the public highway and permanent availability of parking and manoeuvring areas should be provided in the interest of highways safety. The applicant has failed to demonstrate that users of the site can leave in a safe manner in forward gear.
2.Additional information was sought however was not provided in the correct format by way of scale drawings. The applicant sought to address the highway concerns however these are not acceptable and have been shown outside of the application site and blocking the access/circulatory route. There is no other provision for turning or access and that which has been provided is not acceptable in highway terms. It is not possible to condition the application to make it satisfactory or safe in highway terms given the constraints of the site within the red line plan. Therefore the application is contrary to policy CS9 of the Core Strategy and should be refused inline with paragraph 109 of the National Planning Policy Framework.
3.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
