1.The proposed development site contains a large, mature and attractive Horse Chestnut tree positioned on the western (front) boundary that is protected by a Tree Preservation Order. The tree provides an important visual benefit to the street scene as well as biodiversity benefits. The proposed dwelling is considered by the Local Planning Authority to have an unacceptable impact upon this tree and its damage or loss would adversely impact the area. Insufficient details have been submitted to provide assurance to the Local Planning Authority that the tree will not be adversely impacted. Accordingly the proposal is considered contrary to paragraph B of policy CS9 of the adopted Core Strategy and paragraph G of policy CS11 of the adopted Core Strategy.
2.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
