| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development hereby permitted shall be carried out in accordance with the submitted application form, flood risk assessment report ref: 2299/RE/06-19/01 and drawing number:1391/1 received on 19 July 2019 by the Local Planning Authority and shall be retained in the approved form thereafter. No material variation from these plans shall take place unless otherwise first agreed in writing with the Local Planning Authority.
The reason for the condition is :-
In order that the development hereby permitted shall be fully implemented in complete accordance with the approved plans and to accord with the Great Yarmouth Borough-Wide Local Plan. |
| 3. | Prior to the first occupation and during the construction of the dwellings hereby permitted the flood evacuation plan, prevention and resilience measures submitted in the flood risk assessment report ref: 2299/RE/06-19/01 received on 19 July 2019 by the Local Planning Authority shall be implemented as follows:
1. ground supported or suspended floors with a damp-proof membrane included within the floor construction and suitable floor finish such as ceramic or concrete based floor tiles. Internal walls shall be prevented from flood damage by fitting flood proof up to the flood level.
2. standard gypsum plasterboard which could be used and removed after a flood event, fittings such as plastic or stainless steel units which are durable and resistance to floodwater
3. raised ground floor electrical sockets above the flood level, insulated wiring for communication cables and non return valves to prevent back flow of flood/foul water.
4. finished ground floor levels should not be lower than 1 metre and first floor levels not lower than 3.60 metres AOD.

| 4. | Prior to the first occupation of the development hereby permitted the proposed access/ on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring areas, in the interest of satisfactory development and highway safety. |
| 5. | Notwithstanding the submitted details unless otherwise agreed in writing by the Local Planning Authority the proposed private drive shall be maintained in perpetuity at a minimum width of 4.2 metres for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway for that said distance.

| 6. | Construction work shall not take place outside the following hours:- 08:00 to 18:00 Monday to Friday, 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property).
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 7. | No deliveries shall be taken at the site outside the following hours:-
08:30 to 18:00 Monday to Friday
09:00 to 13:00 Saturday
and no deliveries shall take place on Sundays or Bank Holidays.
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 8. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the aims of Policies CS2, CS3 and CS9 of the adopted Core Strategy (2015) (CS) and saved Policies HOU7 and HOU17 of the Great Yarmouth Borough-Wide Local Plan. |
| 9. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017.
In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy. |
