| 1. | An HMO represents an intensification of the existing property and is positioned adjacent to a single residential property. This is directly in conflict to criterion E of saved policy HOU23 of the Borough Wide Local Plan. The applicant has not sufficiently shown that the proposal will not adversely affect the neighbouring properties by way of noise and disturbance through the adjoining wall. Accordingly it has not been shown that the proposal conforms to criterion B of saved policy HOU23 of the Borough Wide Local Plan. |
| 2. | The layout of the proposed HMO should create a good standard of amenity as undersized or cramped rooms can lead to an unhealthy environment for the occupant. Room 3 as shown on the submitted plans is not considered to provide the occupant with a good standard of amenity. In addition all rooms should have access to reasonable levels of natural light. The layout as proposed is not considered to conform to paragraph 127 of the National Planning Policy Framework. Consequently the application is recommended for refusal as it does not conform to saved policy HOU23 of the Borough Wide Local Plan (2001) and paragraph 127 of the National Planning Policy Framework. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
