1.The House of Multiple occupation as proposed is considered by the Local Planning Authority to create an unhealthy environment. Room 7 is considered a poor layout where the shape of room restricts useable space and provides limited availability for storage. Room 8 is positioned in the basement and is serviced by a light well. The position and layout of the room means it has a poor outlook and benefits from limited light. Accordingly the proposal is not considered to provide a suitable standard of amenity and creates an unhealthy environment contrary to the aims of paragraph 127 of the National Planning Policy Framework.
2.Limited communal facilities means that occupants of an HMO are restricted to the confines of their rooms. The proposal seeks to remove the existing living room and the lack of a defined living area crates an unhealthy environment. It is also considered that the arrangement of the W/C and bathroom is not considered adequate to serve the proposed rooms. Accordingly the provided communal facilities are not considered to conform with paragraph 127 of the National Planning Policy framework.
3.The increase in the intensity of use of the building to an 8 bed HMO and the increase in density of occupation when considered cumulatively with the neighbouring uses could create an area of unsuitable intensity with the potential to provide disturbance to the amenity of the surrounding area. Accordingly the proposal is considered contrary to criterion B of saved policy HOU23 of the Borough Wide Local Plan. Consequently the application is refused as it does not conform to paragraph 127 of the National Planning Policy framework and saved policy HOU23 of the Borough Wide Local Plan (2001).
4.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
