The reason for the condition is:- In the interests of the visual amenities of the locality
.Prior to occupation of the development hereby permitted details of two no. bat boxes and two no. bird boxes shall be submitted to and approved by the Local Planning Authority. The boxes shall be erected in accordance with the approved details prior to occupation of the development and retained in perpetuity. The reason for the condition is :- To enhance the locality for protected species.
.In accordance with the Ecology Report including Supporting Evidence for Appropriate Assessment submitted in support of the application the below mitigation is to be adhearded to: 1) If the removal of any woody vegetation (scrub, shrubs or trees) is required it will be done outside of the main bird nesting season (1st March - 31st August) to ensure that no active bird nests are damaged or destroyed), or else have the affected vegetation thoroughly checked for bird nests prior to the works. 2)The land between the proposal site and the wet ditch to the south will not be cleared of vegetation. The existing vegetation will be left in situ to filter any run-off from the development site and prevent sediments entering the ditch (which appears to link to the Broads SAC). 3)The piles of rubble and wood currently on site will be removed by hand (not using machinery) between March and October, when small terrestrial animals such as reptiles and amphibians will be active (not hibernating). This will minimise the risk of such animals using the piles as refuge being injured or killed. 4) All subsequent building materials and waste materials will be stored above the ground, such as on pallets or in skips respectively. This measure will ensure that such materials do not provide a sheltering opportunity, attractive to invertebrates, amphibians, reptiles and small mammals. 5) Bats are small and highly mobile mammals which can use a range of roosting sites, some of which can be small and used infrequently. In the unlikely event that a bat is found during works, then construction work will cease until advice has been sought from a professional ecologist. 6) Excavations will not be left open overnight, or else will be fitted with egress boards sloped at a shallow angle (<40°). Preferably all excavations will be covered overnight to prevent animals from falling in. 7) Works will be restricted to daylight hours only to prevent disturbance or accidental harm to nocturnal animals such as badgers and hedgehogs. Night lighting of the site will be minimised to reduce disturbance to other nocturnal animals such as bats and moths. Amphibians typically forage terrestrially at night, so restricting works to occur in daylight hours will minimise the chances of these species encountering the works. 8) The effect on foraging bats posed by the proposal could consist of disturbance through lighting at night; therefore night-lighting of the site will be minimal, and sensitive where essential and approved in writing with the Local Planning Authority prior to use. The use of movement sensors installed on lights can ensure that they come on only when needed and avoid unnecessary constant illumination. Positioning lights at angles of not greater than 90°to the ground can reduce overspill of light and sky glow, which can disrupt the nocturnal behaviours of bats and insects. The reason for the condition is :- To mitigate adverse impacts on the area by the development in accordance with the applicants submitted details.
.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Design and Development Group. Please contact Stuart French on 01603 638070. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy.
.REASON FOR APPROVAL OF THE APPLICATION :- The proposal complies with the aims of Policies CS2, CS3, CS9 CS11 and CS14 of the Great Yarmouth Local Plan and the National Planning Policy Framework.
