| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the application form and approved plans (drawing reference: 7934 04 rev B, 05 Rev A, 06 Rev A and 07 Rev A and 08) received by the Local Planning Authority on 24 August 2018 and the revised plans (drawing reference: 02 Rev C and 03 Rev C) received by the Local Planning Authority on 28 March 2019 and 7934 01 Rev F received by the Local Planning Authority on the 12th April 2019.

| 3. | Prior to the first occupation of the development hereby permitted a vehicular access shall be constructed in accordance with a detailed scheme to be agreed in writing with the Local Planning Authority, in consultation with the Highway Authority and thereafter retained at the position shown on the approved plan. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so it does not discharge from or onto the highway.
The reason for the condition is :-
To ensure construction of a satisfactory access and in the interests of highway safety. |
| 4. | Vehicular and pedestrian and cyclist access to and egress from the adjoining highway shall be limited to the access shown on drawing No.7934 08 only. Any other access or egresses shall be permanently closed, and the footway / highway verge shall be reinstated in accordance with a detailed scheme to be agreed with the Local Planning Authority in consultation with the Highway Authority, concurrently with the bringing into use of the new access.

| 5. | The gradient of the vehicular access shall not exceed 1:12 for the first 5 metres into the site as measured from the near channel edge of the adjacent carriageway.
The reason for the condition is :-
In the interests of the safety of persons using the access and users of the highway. |
| 6. | Any access gates, bollard, chain or other means of obstruction shall be hung to open inwards, set back and thereafter maintained a minimum distance of 5 metres from the near channel edge of the adjacent carriageway. Any sidewalls, fences or hedges adjacent to the access shall be splayed at an angle of 45 degrees from each of the (outside) gateposts to the front boundary of the site.

To enable vehicles to safely draw off the highway before the gate(s) or obstruction is opened. |
| 7. | Prior to the first occupation of the development hereby permitted a visibility splays shall be provided in full accordance with the details indicated on the approved plan (59 x 2.4 x 59 metres). The splay shall thereafter be maintained free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway.

| 8. | Prior to the first occupation of the development hereby permitted the proposed access, on-site car and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety. |
| 9. | No development shall take place or trees shall be removed until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping. The agreed landscaping scheme shall include indications of all existing trees and hedgerows on the land, and details of any to be retained. The landscaping scheme shall include a full Arboricultural Impact Assessment which following the submission of a full landscaping scheme provides details for the protection of the trees during the course of development. The landscaping plan shall include details of all new planting and details of the reinforcement of the planting on the northern boundary.

| 10. | All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever, is the sooner, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

| 11. | No development shall take place until the following information has been submitted to and approved in writing by the
Local Planning Authority:
(i) a full site survey showing:
the datum used to calibrate the site levels
levels along all site boundaries
levels across the site at regular intervals
floor levels of adjoining buildings
(ii) full details of the proposed finished floor levels of all buildings and hard surfaces.
The development shall be carried out only in accordance with the approved details.
No development shall take place until full details of the finished levels, above ordnance datum, of the ground floors of the proposed buildings, in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The development shall be carried out in strict accordance with the levels approved.
The reason for the condtions is:-
To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site. |
| 12. | Prior to the commencement of the development hereby approved details of the boundary treatments shall be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details. The boundary treatments shall be installed prior to the first occupation of the unit to which the boundary treatment relates.
The reason for the condition is :-
In the interests of visual amenity. |
| 13. | No development shall take place until a mitigation strategy detailing the protection of the Great Crested Newts during the construction is submitted to and approved by the Local Planning Authority. The strategy shall also include details of enhancement measures for the Newt habitat. The development shall be carried out in accordance with the approved details. All mitigation measures shall be completed prior to the first occupation of any unit hereby approved.
The reason for the condition is :-
In the interests of supporting and enhancing biodiversity. |
| 14. | No development shall take place until details of the siting of bat boxes have been agreed in writing with the Local Planning Authority. The boxes, as agreed, shall be installed prior to the commencement of any development.
The reason for the condition is :-
To provide nesting sites for bats in accordance with the protected species assessment. |
| 15. | No development shall take place until a full surface water strategy is submitted to and approved by the Local Planning Authority. The strategy shall show how the surface water is accommodated within the site and shall not create a flood risk to either the occupants of the site or the surrounding properties. In addition the surface water strategy shall ensure that no mitigation measures will be detrimental to Great Crested Newt populations found within the site and shall detail any works to the existing ditches.
The development shall be carried out in accordance with the approved details. The surface water scheme shall be fully completed prior to the first occupation of the site hereby approved.
The reason for the condition is :-
In the interests of ensuring water is adequately drained and does not pose an environmental risk. |
| 16. | Notwithstanding the approved plans the windows in the first floor of the northern elevation of units 1 and 4 hereby approved shall be obscure glazed and non-opening and shall remain so in perpetuity. The obscure glazing shall be installed prior to the first occupation of the unit to which they relate.
The windows shall remain obscure glazed and non-opening in perpetuity.
The reason for the condition is :-
In the interest of neighbouring privacy. |
| 17. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) no windows shall be added to the northern elevation above ground floor level of the new build dwellings hereby approved without the consent of the local planning authority.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity. |
| 18. | Construction work shall not take place outside the following hours:-
07:30 to 18:00 Monday to Friday
08:00 to 13:00 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 19. | Prior to the commencement of the development and to the satisfaction of the Environmental Services Manager, a Phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a Phase 2 site investigation is to be carried out to the satisfaction of the Environmental Services Manager. If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed end-use to the Environmental Services Manager. No buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority.

To ensure that risks from land contamination to the future users of the land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 20. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 21. | Notwithstanding the approved plans no work shall commence until a full schedule of works for the barn conversion have been submitted to and approved by the Local Planning Authority; the schedule shall:
a) details of the construction, materials and finishes of all new doors and windows including finishes
b) all items to be retained and removed
c) building repairs
d) all new joinery
e) details of all other materials and finishes to be used in the development
The development shall be carried out using the approved materials.
The reason for the condition is :-
In the interests of the visual amenities of the area as precise details of the materials have not been submitted. |
| 22. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) the converted barn shall not be extended in any way nor shall any windows be inserted without the prior consent of the Local Planning Authority.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of visual amenity. |
| 23. | Prior to occupation details of the proposed arrangements for future management and maintenance of the proposed access road and shared areas within the development have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. (The streets shall thereafter be maintained in accordance with the approved management and maintenance details until such time as an agreement has been entered into under Section 38 of the Highways Act 1980 or a Private Management and Maintenance Company has been established).
The reason for the condition is:-
To ensure satisfactory development of the site and to ensure the roads are managed and maintained thereafter to a suitable and safe standard. |
| 24. | No development shall commence on site until a scheme has been submitted for the provision of the fire hydrant on the development in a location to be agreed by the Local Planning Authority in consultation with Norfolk Fire and Rescue Service. The hydrant shall be installed in accordance with the approved details prior to the occupation of any unit.
The reason for the condition is :-
To ensure adequate water infrastructure provision is made on site for local fire serves. |
| 25. | No development shall take place within the site until the applicant, or their agents or successors in title, has secured the implementation of a programme of historic building recording, whose final report has been submitted by the applicant and approved in writing by the Local planning Authority.
The reason for the condition is :-
In accordance with paragraph 199 of the National Planning Policy framework. |
| 26. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria outlined in saved policy HOU17 of the Borough Wide Local Plan and policies CS2, CS3 and CS9 of the adopted Core Strategy. |
| 27. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |

| 29. | This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing.
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management and Operations team on 0344 800 8020.
If required, street furniture will need to be repositioned at the applicant's expense.
Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. |
