1.The flat as proposed is considered by the Local Planning Authority to be of a substandard size. The proposed flat creates a cramped and unhealthy environment that can adversely affect the health of the occupiers and provides a poor standard of living. In addition the flat will be reliant on light from a single side and it has not been sufficiently demonstrated that the flat will be well lit throughout the day. Accordingly the proposal is considered contrary to paragraph 127 of the National Planning Policy Framework.
2.The development is positioned adjacent to a Medieval Vault which occupies part of the building. In considering whether to grant planning permission for development which affects a listed building or its setting, the local planning authority must have regard to Sections 16 and 66 of the Planning (Listed Buildings and Conservation Areas) Act 1990 which requires the Council to have special regard to the desirability of features of special architectural or historic interest, preserving listed buildings and their settings in exercise of planning functions. The proposal as submitted has not sufficiently demonstrated that the adjacent vault would not be adversely impacted by the proposal. Accordingly the proposal is contrary to paragraph 189 of the National Planning Policy Framework and policy CS10 of the adopted Core Strategy. Consequently the proposal has been refused as it does not comply with paragraph 127 and 189 of the National Planning Policy Framework and policy CS10 of the adopted Core Strategy.
3.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
