1.Dear Mr Muskett, Town and Country Planning Act 1990 (as amended) Town and Country Planning (General Permitted Development) (England) Order 2015 Please accept this letter as formal notification that your application for prior approval to change the use of buildings at land known as 'The Old Telephone Exchange' to C3 dwelling house is refused. The application fails to comply with Class P of the Town and Country Planning (General Permitted Development) (England) Order 2015 have been met and is refused under paragraph W(3) which reads as follows: (3) The local planning authority may refuse an application where, in the opinion of the authorityâ¿¿ (a) the proposed development does not comply with, or (b) the developer has provided insufficient information to enable the authority to establish whether the proposed development complies with, any conditions, limitations or restrictions specified in this Part as being applicable to the development in question. The application site does not comply with Class P as the site does not fall into use class B8. Application 06/10/0104/CU granted temporary consent for a change of use which expired on the 15th April 2012. At the expiration of the consent the lawful use reverted to the previous use which is not use class B8. As you will be aware as the application failed at the initial point no further assessment is required nor has it been made. In order to assist you I can confirm that the fall-back position in relation to a lawful use has been considered and as 10 years has not passed since the expiration of the planning permission. In addition it was also stated as part of the previous planning appeal that the site was no longer in use. I trust that this additional information is of assistance.
