| 1. | The Southern Hotel is positioned within the conservation area and adjacent the holiday areas as defined under the current Local Plan. The area contains a number of attractive buildings and with good access to the seafront. The site is in a strategically and visually important area which already contains a number of units in multiple occupancy including the neighbours either side which are used for flats. The area contains an intense level of residential units and the creation of a House of Multiple Occupation (HMO) will exacerbate intensity to a level which degrades the wider area by impacting upon the neighbours and impacting the holiday offer. Accordingly the proposal is considered contrary to saved policy HOU23 part D of the Borough Wide Local Plan. The proposal as submitted has not adequately demonstrated a suitable level of amenity for the occupiers of the HMO. It has not been shown that the noise levels within the property between the walls will be acceptable for residential living. Accordingly the proposal is not considered to conform to paragraph 127 of the National Planning Policy Framework. Consequently the application has been refused as it does not conform to saved policy HOU23 of the Borough Wide Local Plan and paragraph 127 of the National Planning Policy Framework. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
