1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the details contained in the planning application forms and drawing no. 1820-002 received by the Local Planning Authority on 15th June 2018 and the revised drawing no. 1820-001 rev. B received by the Local Planning Authority on 22nd August 2018.

3. | Notwithstanding the submitted details, unless otherwise agreed in writing by the Local Planning Authority, the proposed private drive shall be maintained in perpetuity at a minimum width of 3.5 metres for its complete length and shall be constructed perpendicular to the highway carriageway for a minimum length of 10 metres as measured from the near edge of the highway carriageway.

4. | Prior to the first occupation of the dwellings hereby permitted, the vehicular access shall be widened across the site's roadside frontage in accordance with the attached Norfolk County Council residential access construction specification (TRAD 1) for the width of the property boundary as measured back from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway carriageway.

5. | No part of the proposed structure (to include fascia board, rainwater goods and guttering) shall overhang or encroach upon highway land and no gate, door or ground floor window, if installed, shall open outwards over the highway.

6. | The garage doors fronting Bells Marsh Road shall be of a roller shutter type or similar so as not to open outwards over the highway.

7. | Prior to the first occupation of the dwellings hereby permitted, the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.

To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety. |
8. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting the order) no windows or other openings (except those shown on the approved drawing) shall be inserted into the walls or roof of the dwellings hereby permitted.

9. | The dwellings hereby permitted shall not be occupied until the boundary walls/fences have been provided in accordance with the approved drawing no. 1820-001 rev. B.

10. | The development hereby permitted shall be carried out incorporating the measures to mitigate the risk from flooding set out in the submitted Flood Risk Assessment (reference 1528/RE/01-16/01 revision B) dated June 2018.

To ensure that mitigation measures are undertaken as the property is located within an area at risk of flooding. |
11. | Demolition and construction work shall not take place outside the following hours:-
08:00 to 18:00 Monday to Friday
08:30 to 13:30 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)

12. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposals meet the aims of Policy CS1 of the Great Yarmouth Local Plan: Core Strategy and saved Policy HOU7 of the Great Yarmouth Borough-Wide Local Plan. |
13. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
14. | NOTES - Please read the following notes carefully:-
1) This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing.
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management Group. Please contact Stuart French on 01603 638070.
If required, street furniture will need to be repositioned at the applicant's expense.
Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
2) This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. 3) It is the applicant's responsibility to clarify the boundary with the public highway. Private structures such as fences or walls will not be permitted on highway land.
