| 1. | The structure is positioned adjacent to a public highway and involves vehicular movements in close proximity to the structure. The proposal has not been sufficiently demonstrated that the structure will not have an adverse impact upon the safety and efficiency of the public highway. Accordingly the Local Planning Authority cannot be satisfied that it complies with the provisions of paragraph C of policy CS16 of the adopted Core Strategy. Furthermore the site is located within flood zone 3 and it has not been shown that in a flood event that the structure will be sufficiently stable. In accordance with paragraph 163 of the National Planning Policy Framework development should be appropriately flood resistant and resilient. |
| 2. | The proposed containers are of a poor visual quality and are positioned in a highly visible location. The units are immediately adjacent the public highway and positioned in front of the property meaning the proposed units have a large visual impact. The layout and design is not considered of a sufficient quality and the proposal is considered contrary to policy CS1 of the adopted Core Strategy paragraph F. Consequently the application has been refused as it does not comply with policies CS1 and CS16 of the adopted Core Strategy. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
