| 1. | No development whatsoever shall take place until full details of the appearance, layout, landscaping and scale of the development (herein after referred to as the reserved matters) have been submitted to and approved by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details.
The reason for the condition is:-
Such details have not been submitted as part of this application. The layout shall include full details of the parking and cycle provision as well as details of the turning areas. |
| 2. | Application for approval of reserved matters must be made not later than the expiration of three years beginning with the date of this permission and the development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved.
The reason for this condition:-
The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 3. | The development hereby approved shall be carried out in accordance with the approved Flood Risk Assessment (FRA) prepared by Evans River and Coastal, referenced 1888/RE/08-17/01 and dated August 2017 and the following mitigation measures detailed within the FRA:
1) The ground floor shall only be used for the uses as detailed on drawing 050 revision P00 and dated 24 April 2017
2) Habitable accommodation shall be provided on the first floor and above only with the first floor levels being set no lower than 4.3 metres above Ordnance Datum (AOD)
3) The building shall be designed to withstand the hydrostatic and hydrodynamic pressures that could be experienced during an overtopping or breach event (which ever exerts the greatest pressures) for all events up to and including the 0.1% (1 in 1000 year) annual probability flood event, inclusive of climate change.
The mitigation measures shall be fully implemented prior to first occupation of any residential unit hereby approved and subsequently in accordance with the timing/phasing arrangements embodied within the scheme or with any other periods.
The reason for the condition is :-
1) To reduce the risk of flooding to the proposed development and future residents.
2) To reduce the risk of flooding to the proposed development and future residents.
3) To ensure the building is capable of providing refuge should flooding occur. |
| 4. | Prior to the commencement of the use hereby permitted the vehicular access (on Exmouth Road) shall be widened to the width of the development frontage in accordance with the Norfolk County Council residential access construction specification for the width of the footway and measured back from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway carriageway.

| 5. | Notwithstanding the submitted details and unless otherwise agreed in writing by the Local Planning Authority the proposed private drive shall be maintained at a minimum width of 4.5 metres for its complete length and shall be constructed perpendicular to the highway carriageway for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway for that distance.

| 6. | Notwithstanding the provisions of Class A of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015, (or any Order revoking, amending or re-enacting that Order) no gates, bollard, chain or other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved by the Local Planning Authority.

| 7. | The demolition of the building shall not commence until an asbestos survey has been submitted to and approved by the Local Planning Authority in consultation with the Head of Environmental Services. The survey shall identify asbestos materials and provide details of the safe removal of asbestos from the building as well as any mitigation measures required. The proposal shall be carried out in accordance with the approved details.

In the interests of the health of neighbouring properties. |
| 8. | Prior to the commencement of the development and to the satisfaction of the Head of Environmental Services, a Phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a Phase 2 site investigation is to be carried out to the satisfaction of the Head of Environmental Services . If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed end-use to the Environmental Services Manager. No buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority.

To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 9. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.

| 10. | Construction and demolition work shall not take place outside the following hours:-
07:30 to 18:00 Monday to Friday
08:00 to 13:00 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)

In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 11. | Prior to the commencement of the development hereby approved a noise assessment shall be submitted to and approved in writing by the Local Planning Authority. The submitted details shall include noise mitigation and insulation measures and details of the noise levels experienced within the site. The development shall be implemented in accordance with the approved details prior to the first occupation of any residential unit hereby approved and shall be maintained thereafter in perpetuity.
The reason for the condition is :-
In the interests of the amenities of the occupiers of the units. The noise assessment will detail the levels of noise experienced by the occupiers from surrounding sources and ensure full and suitable mitigation measures are proposed to reduce noise levels to those prescribed within the Environmental Health comments. |
| 12. | Prior to the occupation of any residential unit hereby approved, a flood response plan shall be submitted to and agreed in writing with the Local Planning Authority. This flood response plan, including information regarding the availability of the Environment Agency's Flood Warnings Service, shall be made available to future occupiers of the site.
The reason for the condition is :-
In accordance with the recommendations of the flood risk assessment, to minimise the risk to the occupants in the event of flooding. |
| 13. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria outlined in saved policy HOU7 of the Borough Wide Local Plan and policies CS2, CS3, CS6 and CS9 of the adopted Core Strategy. |
| 14. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |

| 16. | This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing.
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
