1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plan (drawing reference LOC-43, PL46 Rev A, 02 Rev R, NHHY2/20- Rev L and 01 Rev S) received by the Local Planning Authority on 15 March 2018. The slab levels of the dwellings hereby approved shall be in accordance with plan NHHY2/02 - Rev L. The landscaping shall be carried out in accordance with plan 01 Rev S and the access shall be built in accordance with the plan (drawing reference NHHY2/111C) received by the Local Planning Authority on the 7 June 2018. The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) the dwellings shall not be extended in any way without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity.
4.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) other than the windows shown on the approved plans no windows shall be installed above ground floor without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity.
5.Prior to the first occupation of plots 43 and 44 as shown on the approved plans a 1.8 metre high close boarded fence shall be erected on the eastern site boundary adjacent to the ditch. The reason for the condition is :- To ensure the new residential development does not adversely impact on the neighbouring drainage ditch which is outside the application site.
6.Prior to the first occupation of the development hereby permitted the proposed access and on-site car parking shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety.
7.Prior to the first occupation of the development hereby permitted a visibility splay shall be provided in full accordance with the details indicated on the approved plan. The splay shall thereafter be maintained free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety.
8.The site will potentially generate significant noise and dust during clearance, demolition and construction. The following hours of work should be adhered to:- Construction work shall not take place on the site outside of the following hours: Monday to Friday 0730 to 1900 Saturday 0800 to 1300 No working Sundays or Bank Holidays Where piling is to be employed, the quietest appropriate method should be used and the following hours of work adhered to:- Monday to Friday 0830 to 1700 Saturday 0900 to 1300 No working Sundays or Bank Holidays An adequate supply of water protected from frost shall be available for use in suppressing dust. There shall be no burning of materials on site nor lights on the site that may cause a disturbance to wildlife during hours of darkness. The reason for the condition is :- In the interests of the residential amenity of the area.
9.All drainage ditches shall be maintained and kept clear of obstruction for surface water drainage purposes unless otherwise agreed in writing with the Local Planning Authority. The reason for the condition is :- To ensure no adverse impact on the surface water drainage in the locality.
10.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in saved policy HOU7 of the Borough Wide Local Plan and policy CS9 of the adopted Core Strategy.
11.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
