No.Condition Text
.The application does not contain sufficient information to demonstrate that the development will not be a significantly detrimental impact on the Winterton - Horsey Dunes Site of Special Scientific Interest, Winterton - Horsey Dunes Special Protection Area, Winterton - Horsey Dunes Special Area of Conservation, The Norfolk Coast Area of Outstanding Beauty or the Winterton Dunes Nature Reserve. In the absence of such information as required by the Habitats Regulations an appropriate assessment cannot be carried out. Given the special sensitivity of the area in which the development is proposed , to allow the development without the an appropriate assessment would be contrary to the Great Yarmouth adopted Core Strategy and the Conservation of Habitats and Species Regulations 2017. The application has not demonstrated that the Natura 2000 site, within which the development is proposed and is protected will not be subject to significant adverse effects owing to the construction, increase in visitor numbers and impacts to interest features. In addition there has been no mitigation proposed to seek to off set the impacts of the development.
.The application does not contain a landscape visual impact assessment and therefore the effect on the Area of Outstanding Natural Beauty has not been properly assessed by the applicant. In assessing the visual impact on the area the local planning authority considers the impact of the development to be unacceptable owing to colour, design, location, size and massing. The size, massing and location of the development proposed would dominate the landscape and significantly erode the special nature of the area by urban erosion. The erosion would be further exacerbated by the height of the proposed development. The materials and colour proposed are inappropriate in this location and further compound the significant adverse impacts of the development and do not reflect the character of the area. The development as proposed would cause the loss of designated features of interest and is not appropriate within a special area of conservation. In accordance with paragraph 115 of the National Planning Policy Framework sufficient weight has been placed upon the conservation of the Area of Outstanding Natural Beauty.
.The application is contrary to the Habitats Regulations, The Norfolk Coast Area of Outstanding Natural Beauty Management Plan, Great Yarmouth adopted Core Strategy with specific reference policies CS11 and CS8, the National Planning Policy Framework with specific reference paragraphs 9, 17, 61 and 109.
.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
