| 1. | The internal layout of the proposed HMO is not deemed by the Local Planning Authority to provide a sufficient standard of amenity for the occupants due to an undersized room positioned on the first floor. The resultant room layout will create a development that is cramped and provides a poor environment for the occupier. Accordingly the proposal is considered contrary to the aims of the National Planning Policy Framework paragraph 127 (f) which states that there should be a high standard of amenity for all existing and future users. |
| 2. | It has not been demonstrated that the front facing room within the basement received sufficient levels of light. The room is located below the level of the pavement to the front which reduces the amount of light the room received. Poor levels of light can create a dark and unhealthy environment. Unless demonstrated by the applicant the levels of light are acceptable it does not comply with paragraph 127. Consequently the application for an enlarged HMO has been refused as it does not comply with the provision of paragraph 127 of the National Planning Policy Framework. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
