1.This permission varies conditions 2 and 11 of planning permission 06/16/0332/F in relation to highway changes and internal layout only. Conditions 1-21 of permission 06/16/0332/F with the exclusion of the approved plans and details subject to this application must be complied with. The reason for the condition is :- In the interest of clarity and in accordance with the application.
2.The following replaces condition 2 of 06/16/0332/F. The development shall be carried out in accordance with the application form, associated information and following plans: Revised Site layout drawing no.12-174-001-P001-REV D:Revised drawing 12-174-001-P004 Rev D: Revised Site Location Plan Drawing ref: 12-174-001-P001-D:Revised Restaurant Elevations Drawing 12-174 POO4 Revision D:Units 2 and 3 Plans and elevations-subsidary buildings Drawing No. 12-174-001 POO6 Rev G: Proposed Site Access Drawing No.25972_5503_008 Revision A. The reason for the condition is :-For the avoidance of doubt and in accordance with the submitted and approved plans.
3.The following replaces condition 11 of 06/16/0332/F. Notwithstanding the details indicated on the submitted drawings no works shall commence on site unless otherwise agreed in writing until a detailed scheme for the off-site highway improvement works as indicated on drawing number 25972-5503-008 Rev A) have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
4.Prior to the commencement of the use hereby permitted the off-site highway improvement works referred to in Condition 3 of this condition shall be completed to the written satisfaction of the Local Planning Authority. Reason: To ensure that the highway network is adequate to cater for the development proposed.
5.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
6.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in Policy CS6 of the Great Yarmouth Local Plan: Core Strategy 2013-2030.
7.NOTES - Please read the following notes carefully:- The applicants are reminded that Application 06/16/0332/F and this variation of conditions 2 and 11 is subject to an agreement dated 19 December 2017 made pursant Section 106 of the Town and Country Planning Act 1990. The off-site works will be delivered by a Section 278 Agreement and the precise delivery mechanism will be determined as the works are brought forward. The applicant should be aware that there may be additional costs relating to the off-site works which will include a commuted maintenance amount as well as various fees including administration and supervision. The completed works will be subject to a Safety Audit and additional works may be required. Please be aware it is the applicants responsibility to clarify the boundary with the public highway. Private structures such as fences or walls will not be permitted on highway land. The highway boundary may not match the applicants title plan.
