1.The proposed development is located within a constrained area with its main windows servicing the bedrooms on the first floor looking outwards directly into the neighbouring property opposite. Given the relative distances between the neighbouring property and the proposed dwelling the proposal is considered to significantly and adversely affect this neighbouring property in terms of loss of outlook and loss of privacy. The proposed dwelling is also located close to the rear of 13 St Peters Road. A proposed two storey structure positioned close to the rear windows of 13 St Peters Road will have a significant and adverse impact in terms of loss of outlook and overshadowing. The enclosing of the rear windows will reduce light into the properties and create a significant imposition. Accordingly the proposal is considered contrary to criterion E of saved policy HOU7 of the Borough Wide Local Plan. In addition paragraph 17 of the National Planning Policy Framework states that a good standard of amenity for all existing and future occupants should be created which the Local Planning Authority considers in this instance not to be created.
2.The proposal creates a single dwelling within a garden plot. The proposed development is not considered to have a sufficient amenity space for a dwelling of this size and form. Whilst it is recognised that the area is relatively densely built it is considered by the Local Planning Authority that the level of curtilage attributed to the detached property is not considered sufficient. The curtilage is also shared with 13 St Peters Road meaning both properties do not have sufficient levels of curtilage.
3.The character of the area is predominantly formed of terrace properties and commercial units. Within the vicinity of the application site the residential properties facing inwards have a defined pattern of facing towards areas of open space. The prevailing character is disrupted by the development and the Local Planning Authority considers on balance that the proposed development does not conform to criterion A of saved policy HOU7 of the Borough Wide Local Plan and part A of policy CS9 of the adopted Core Strategy. Consequently the application has been refused as it does not confirm with the provisions of saved policy HOU7 of the Borough Wide Local Plan and policy CS9 of the Adopted Core Strategy.
4.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
