| 1. | The room positioned within the basement is not considered by the Local Planning Authority to provide a sufficient level of amenity for the occupier. The occupier would not benefit from sufficient levels of light and would have a poor outlook. The resultant development would be a dark an oppressive environment for the occupier. Accordingly the proposal is not considered consistent with the aims of paragraph 17 of the National Planning Policy Framework which sets out the core planning principles which should underpin both plan-making and decision-taking .
In addition the communal kitchen/dining room located within the basement is also considered by the Local Planning Authority to have poor levels of light and outlook. Creating good communal facilities is important in creating a good standard of environment. Poor communal facilities will result in the occupants of the HMO being restricted to their rooms. |
| 2. | The proposal is adjacent to single residential properties and is positioned on a road largely defined by single residential properties. The development is considered contrary to the established pattern of development and would create a development out of character with its surroundings. In addition the use is intensive in comparison to its surroundings which could create a disturbance to the neighbouring properties. Accordingly the development is considered contrary to saved policy HOU23 of the Borough Wide Local Plan criterions C, E and F. |
| 3. | Insufficient information has been submitted regarding the flat above and whether it would create a subdivision. The application shows a unit of private accommodation above, this unit appears to be distinctly separate and its occupant would have to move through an active HMO to access it. This is not considered a suitable layout as the occupier would be subject to significant disturbance in doing so. The creation of an additional unit at this site is unsympathetic to the wider character of the area in accordance with saved policies HOU7 (criterion A) and HOU23 (criterion B) of the Borough Wide Local Plan.
Consequently the application is refused as it does not conform to saved policies HOU23 and HOU7 of the Borough Wide Local Plan and paragraph 17 of the National Planning Policy Framework. |
| 4. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
