| 1. | By virtue of the current and potential future harm of this late night use in close proximity to residential properties in the form of visiting traffic, outside smoking, and operating noise the use does, and would result in nuisance and disturbance to occupants of the existing and approved neighbouring residential properties in this predominantly residential area. On balance therefore the impact of this development upon the amenity of residential properties is contrary to part F of Policy CS9 (Encouraging well-designed, distinctive places) of the Great Yarmouth Local Plan and the continued use as an adult club is considered to be an unacceptable form of development. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
