1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the revised plan received by the Local Planning Authority on the 8th January 2018 (reference 2032.16.4A) and plans and form received by the Local Planning Authority on the 24th August 2017 (reference 2032.16.5, 2023.16.6 and 2032.16.3).

3. | No gate, door, ground floor window if installed shall open outwards over the highway.

In the interests of highway safety. |
4. | Prior to the commencement of the use hereby permitted the proposed on-site car and cycle parking and servicing turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan (reference 2032.16.3). Prior to the commencement of the use hereby permitted a scheme is to be submitted to and approved by the Local Planning Authority in consultation with the Highway Authority for the parking areas to be marked/signed for their intended use. The development shall be carried out in accordance with the approved scheme prior to the commencement of the use hereby permitted and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety. |
5. | Prior to commencement of development, in accordance with the submitted Drainage Statement (Canham Consulting Ltd, ref. 210526, November 2017) designs of a surface water drainage scheme incorporating the following measures shall be submitted to and agreed with the Local Planning Authority in consultation with the Lead Local Flood Authority. The approved scheme will be implemented prior to the first occupation of the development. The scheme shall address the following matters:
I. Detailed Contamination Report to show the presence of no significant contaminations. Should areas of no significant contamination be present on site, then infiltration should be considered as the part of the drainage strategy.
II. Detailed infiltration testing in accordance with BRE Digest 365 at depths and locations of the proposed attenuation/infiltration devices.
III. An agreement in principal to discharge to their system should be provided from Anglian Water should infiltration be unviable on site.
IV. Provision of surface water attenuation storage, sized and designed to accommodate the volume of water generated in all rainfall events up to and including the critical storm duration for the 1 in 100 year return period, including allowances for climate change, flood event. A minimum storage volume of 81.2 m3 will be provided in line the submitted Drainage Strategy.
V. Detailed designs, modelling calculations and plans of the of the drainage conveyance network in the:
1) 1 in 30 year critical rainfall event to show no above ground flooding on any part of the site.
2) 1 in 100 year critical rainfall plus climate change event to show, if any, the depth, volume and storage location of any above ground flooding from the drainage network ensuring that flooding does not occur in any part of a building or any utility plant susceptible to water (e.g. pumping station or electricity substation) within the development.
FEH data should be applied for all rainstorm durations above 1 hour.
VI. Details of how all surface water management features to be designed in accordance with The SuDS Manual (CIRIA C753, 2015), including appropriate treatment stages for water quality prior to discharge.
VII. Revised maintenance and management plan detailing the activities required and details of who will adopt and maintain the all the surface water drainage features present on site for the lifetime of the development.
The reason for the condition is:-
To prevent flooding in accordance with National Planning Policy Framework paragraph 103 and 109 by ensuring the satisfactory management of local sources of flooding surface water flow paths, storage and disposal of surface water from the site in a range of rainfall events and ensuring the surface water drainage system operates as designed for the lifetime of the development. |
6. | The landscaping as shown on drawing reference 2032.16.3, with the exception of the raised beds as annotated on the approved drawing, shall be completed in accordance with the approved drawing prior to the end of the first planting season following the commencement of the use of the development hereby approved.
The reason for the condition is :-
To ensue the landscaping is carried out to a suitable standard within a suitable timeframe. |
7. | Prior to the commencement of the use hereby permitted details of the boundary treatments at the north eastern corner boundary shall be submitted to and approved by the Local Planning Authority. The boundary treatments as shown on drawing 2032.16.3 and the approved further information shall be completed prior to commencement of the use hereby approved.
The reason for the condition is :-
To ensure adequate boundary treatments are erected. |
8. | Notwithstanding the provisions of Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order) the premises shall not be permitted to be used for any purpose other than that applied for, a residential care home under use class C2 of the Town and Country Planning (Use Classes) Order 1987 (as amended) without the prior written consent of the Local Planning Authority.
The reason for the condition is :-
To enable the Local Planning Authority to retain control over the use of the premises. |
9. | Construction work shall not take place outside the following hours:-
07:30 to 18:00 Monday to Friday
08:00 to 13:30 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
10. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
11. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria set out in Policy CS3 of the adopted Great Yarmouth Core Strategy 2015. |
