1.---------------------------------------------------------------------------------------------------------------------- Particulars of planning permission reserving details for approval:- Application No.:- 06/16/0353/O, Erection of three bedroom detached dwelling at The Bakery, The Street, Hemsby ---------------------------------------------------------------------------------------------------------------------- Particulars of details submitted for approval:- Access, Appearance, Layout, Landscaping and Scale.
2.The development shall be carried out in accordance with the application form and approved plans (RM 170811/03 and RM170811/04) received by the Local Planning Authority on the 23 August 2017 and the revised plan (RM 170811/02 Rev A) received by the Local Planning Authority on 17 October 2017 and the revised location plan received on the 23 October 2017 and the roof tile details received by the Local Planning Authority on the 13 November 2017. The reason for the condition is :- For the avoidance of doubt.
3.Prior to the first occupation of the development hereby permitted the vehicular accesses shall be provided and thereafter retained in the position shown on the approved plan (drawing number RM 170811/02 Rev A) in accordance with the attached highway specification (Drawing No. TRAD 1 and 3). Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is :- To ensure satisfactory access into the site and avoid carriage of extraneous material or surface water from or onto the highway.
4.Vehicular and pedestrian (and cyclist) access to and egress from the adjoining highway shall be limited to the accesses shown on drawing No. RM170811/02 Rev A only. Any other accesses or egresses shall be permanently closed, and the footway / highway verge shall be reinstated in accordance with a detailed scheme to be agreed with the Local Planning Authority in consultation with the Highway Authority, concurrently with the bringing into use of the new access. The reason for the condition is :- In the interests of highway safety.
5.Notwithstanding the submitted details unless otherwise agreed in writing by the Local Planning Authority the proposed private drive shall be maintained in perpetuity at a minimum width of 6.0 metres for its complete length and shall be constructed perpendicular to the highway carriageway. The reason for the condition is :- In the interest of highway safety and traffic movement.
6.Notwithstanding the provisions of Class A of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015, (or any Order revoking, amending or re-enacting that Order) no gates, bollard, chain or other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved by the Local Planning Authority. The reason for the condition is :- In the interests of highway safety.
7.Prior to the commencement of the use hereby permitted the proposed accesses and on-site car parking areas shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety.
8.No demolition/development shall take place/commence until a Written Scheme of Archaeological Investigation has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and 1. The programme and methodology of site investigation and recording 2. The programme for post investigation assessment 3. Provision to be made for analysis of the site investigation and recording 4. Provision to be made for publication and dissemination of the analysis and records of the site investigation 5. Provision to be made for archive deposition of the analysis and records of the site investigation 6. Nomination of a competent person or persons/organization to undertake the works set out within the Written Scheme of Investigation The reason for the condition is :- To preserve items of historical and archaeological importance as the site is within an area of high archaeological importance.
9.No demolition/development shall take place other than in accordance with the Written Scheme of Investigation approved under condition 8. The reason for the condition is :- To preserve items of historical and archaeological importance as the site is within an area of high archaeological importance.
10.The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition 8 and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured. The reason for the condition is :- To preserve items of historical and archaeological importance as the site is within an area of high archaeological importance.
11.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) other than the windows shown on the approved plan no windows shall be inserted above ground floor level without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity.
12.Prior to commencement of the development hereby approved full details of the surface water drainage shall be submitted to and approved by the Local Planning Authority and shall demonstrate that no surface water shall discharge onto the public highway or neighbouring properties. The development shall be carried out in accordance with the approved plans. The reason for the condition is:- To ensure adequate drainage provision in an area of critical drainage.
13.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Monday to Friday 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
14.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in saved policies HOU7 and HOU17 of the Borough Wide Local Plan and policies CS2, CS3 and CS9 of the adopted Core Strategy.
15.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
16.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management and Operations team on 0344 800 8020. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
17.Please be aware it is the applicants responsibility to clarify the boundary with the public highway. Private structures such as fences or walls will not be permitted on highway land.
