1.This permission expires on 1 December 2023 and unless on or before this date application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority the use shall be discontinued and all equipment removed. The reason for the condition is:- In order to retain control over the use of the site in the interest of the amenities of the locality and to ensure the Highway is not obstructed.
2.The development shall be carried out in accordance with the application form received by the Local Planning Authority on 14 August 2017 and the revised location plan received by the Local Planning Authority on the 23 November 2018. The barriers shall be in accordance with the details received by the Local Planning Authority on the 14 August 2017 and shall be erected to a height no greater than 1 metre. The reason for the condition is :- For the avoidance of doubt.
3.No use of the seating area shall occur between 21:00hours and 08:00hours unless otherwise agreed in writing with the local planning authority. The approved tables, chairs and barriers must be removed each day after trading has ceased and be stored safely and securely in a locked compound or within the main building. The reason for the condition is :- In the interests of visual amenity and to avoid disruption of the highway. In addition the storing of the tables and chairs will reduce potential for damage to unsupervised furniture.
4.Notwithstanding the submitted plans the seating area hereby approved shall extend no further than 3.65 metres from the front boundary of 53/54 Marine Parade, Great Yarmouth. No tables, chairs, barriers or any other equipment shall be sited further than 3.65 metres from the front boundary of 53/54 Marine Parade, Great Yarmouth at any time. The reason for the condition is :- To ensure the seating area is retained within an area that does not obstruct the highway in accordance with the submitted details.
5.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in saved policy TR21 of the Borough Wide Local Plan and policies CS8, CS9 and CS10 of the adopted Core Strategy.
