| 1. | This permission relates to the removal of condition 1 of 06/13/0224/CU only. All other conditions of permission 06/13/0224/CU are to be complied with.

| 2. | The property shall be occupied by not more than 6 individuals as a class C4 House in Multiple Occupancy as defined by the The Town and Country Planning (Use Classes) Order 1987 as amended.
The reason for the condition is :-
To ensure that the intensity of use does not exceed that envisaged when granting the original application 06/13/0224/CU as a smaller HMO. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
| 4. | REASON FOR APPROVAL OF THE APPLICATION :-
Whilst the use of the property as a HMO does not meet all the criteria as set out in saved Policy HOU23 of the Great Yarmouth Borough-Wide Local Plan, it is considered that the removal of this condition, would not further harm the amenities of neighbours or the character of the area as the existing lawful use. |
| 5. | NOTES - Please read the following notes carefully:-
The permission 06/13/0224/CU of which this application removes condition 1 from relates to the use of the building as a smaller HMO (as defined by the Use Class Order as a C3(c) residential dwelling). Therefore no more than 6 individuals can occupy the property. If it is the intention to let the property to more than 6 individuals the use class of the property would change, and would be classed as a Larger HMO which is a sui generis use. This would require planning permission.
It is advised that the following security measures are installed in line with the recommendations of the Norfolk Constabulary:-
1. Individual flat doors to be certified to no less than PAS 24:2012 and have no letter plate installed, thereby reducing the risk of theft and arson
2. Mail deliveries should all be contained at the front door to the house, into anti-theft and fire proof postal box, e.g. TS009:2012 standard, preferably placed outside the fabric of the building
3. Windows must be fitted with locks
4. Rear fencing and inter garden fencing should be at least 1.8m high with lockable rear gate to the same height
5. Secure cycle provision should be provided and certificated to the Sold Secure, Silver standard as a minimum
6. Security lighting of the rear garden/courtyard should use vandal resistant, low level wattage lighting controlled by a dusk to dawn sensor. |
