| 1. | The proposed new dwelling is positioned in close proximity and adjacent to the front elevation of the existing property thus creating a cramped development that adversely impacts the setting of the existing property. This relationship between the proposed and existing dwelling is not considered suitable creating a layout which detracts from the important character of the area. Accordingly the proposal is considered contrary to policy HOU7 and HOU17. The proposed dwelling is a tall structure to allow rooms within the roof. This additional height and mass further exacerbates the negative impact to the existing property as well as the property positioned immediately to the east. The proposal is within a conservation area and the proposal is not considered to conserve or enhance the conservation area. Accordingly it is considered contrary to policy CS10 of the adopted Core Strategy. Consequently the application has been refused as it does not conform to saved policies HOU7 and HOU17 of the Borough Wide Local Plan and policies CS9 and CS10 of the adopted Core Strategy. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
