1. | No development whatsoever shall take place until full details of the Appearance, Landscaping and Scale of the development (herein after referred to as the reserved matters) have been submitted to and approved by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details.
The reason for the condition is:-
Such details have not been submitted as part of this application. |
2. | Application for approval of reserved matters must be made not later than the expiration of three years beginning with the date of this permission and the development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved.
The reason for this condition:-
The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
3. | Prior to the first occupation of the development hereby permitted the vehicular access shall be provided and thereafter retained in the position shown on the approved plan (drawing number: 16 7125 012) in accordance with the attached highway specification (Drawing No. TRAD 1). Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway.
The reason for the condition is :-
To ensure satisfactory access into the site and avoid carriage of extraneous material or surface water from or onto the highway. |
4. | Notwithstanding the submitted details unless otherwise agreed in writing by the local planning authority the proposed private drive shall be maintained at a minimum width of 5.8 metres for its complete length and shall be constructed perpendicular to the highway carriageway for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway over the said distance.

In the interest of highway safety and traffic movement. |
5. | Prior to the first occupation of the development hereby permitted a visibility splay measuring 2.4 X 43 metres shall be provided to each side of the access where it meets the highway and such splays shall thereafter be maintained free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway.

6. | Prior to the first occupation of the development hereby permitted the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety. |
7. | Notwithstanding the details indicated on the submitted drawings no works shall commence on site, unless otherwise agreed in writing with the Local Planning Authority, until a detailed scheme for the off-site highway improvement works (footway, access and carriageway widening as appropriate) have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority.
The reason for the condition is :-
To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor. |
8. | Prior to the first occupation of the development hereby permitted the off-site highway improvement works referred to in condition 7 of this permission shall be completed to the written satisfaction of the Local Planning Authority in consultation with the Highway Authority.
The reason for the condition is :-
To ensure that the highway network is adequate to cater for the development proposed. |
9. | No works shall commence on the site until the Traffic Regulation Order for a 30mph speed limit fronting the development has been promoted by the Highway Authority.
The reason for the condition is :-
In the interests of highway safety. |
10. | Prior to the commencement of the development hereby approved full details of the boundary treatments shall be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details.
The reason for the condition is :-
In the interests of visual amenities. |
11. | No development shall take place and no trees nor hedgerows shall be removed from the site until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping, which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development in the form of an Arboricultural Method Statement.The development shall be carried out in accordance with the approved details.

In the interests of the visual amenities of the locality. |
12. | All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever, is the sooner, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

13. | No development shall take place until the following information has been submitted to and approved in writing by the
Local Planning Authority:
(i) a full site survey showing:
the datum used to calibrate the site levels
levels along all site boundaries
levels across the site at regular intervals
floor levels of adjoining buildings
(ii) full details of the proposed finished floor levels of all buildings and hard surfaces.
The development shall be carried out only in accordance with the approved details.
No development shall take place until full details of the finished levels, above ordnance datum, of the ground floor(s) of the proposed building(s), in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The development shall be carried out in strict accordance with the levels approved.
The reason for the condtions is:-
To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site. |
14. | The layout shall be carried out in accordance with the approved plan (drawing reference: 16 7125 012) received by the Local Planning Authority on the 27 April 2017
The reason for the condition is :-
In the interests of clarity. |
15. | Prior to the commencement of the development hereby approved a scheme for surface water management shall be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details.
The reason for the condition is :-
To ensure surface water does not leave the site and adversely affect neighbours and the local environment. |
16. | Prior to the commencement of the development hereby approved a bat survey shall be undertaken which shall ascertain if any bats are present within the site and shall include mitigation measures should bats be present. The development shall be carried out in accordance with the approved details.
The reason for the condition is :-
In the interests of environmental protection. |
17. | Construction work shall not take place outside the following hours:-
07:30 to 18:00 Monday to Friday
08:00 to 13:00 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)

In the interests of the residential amenities of the occupiers of nearby dwellings. |
18. | Prior to the commencement of the development and to the satisfaction of the Environmental Health Manager, a phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses.
If contamination is suspected to exist, a phase 2 site investigation is to be carried out to the satisfaction of the Environmental Services Group Manager. If the phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a suitable standard for its proposed end use.
No dwellings/buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those controlled waters, property and ecological systems. |
19. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria outlined in policies CS2, CS3 and CS9 of the adopted Core Strategy. |
20. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
