1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plans (drawing reference: 193:01,02,03,04,05,06 and 07) received by the Local Planning Authority on 24 May 2017. The reason for the condition is :- For the avoidance of doubt.
3.Prior to the first occupation of the development hereby permitted a vehicular and pedestrian / cyclists crossing over the ditch / watercourse shall be constructed in accordance with a detailed scheme to be agreed in writing with the Local Planning Authority, in consultation with the Highway Authority. The reason for the condition is :- To ensure construction of a satisfactory access and in the interests of highway safety.
4.Vehicular and pedestrian and cyclist access to and egress from the adjoining highway shall be limited to the access shown on drawing No.193/07 only. Any other access or egresses shall be permanently closed, and the footway / highway verge shall be reinstated in accordance with a detailed scheme to be agreed with the Local Planning Authority in consultation with the Highway Authority, concurrently with the bringing into use of the new access. The reason for the condition is :- In the interests of highway safety.
5.Notwithstanding the submitted details unless otherwise agreed in writing by the Local Planning Authority the proposed private drive shall be maintained at a minimum width of 4.5 metres for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway for that said distance. The reason for the condition is :- In the interest of highway safety and traffic movement.
6.The gradient of the vehicular access shall not exceed 1:12 for the first 5 metres into the site as measured from the near channel edge of the adjacent carriageway. The reason for the condition is :- In the interests of the safety of persons using the access and users of the highway.
7.Prior to the first occupation of the development hereby permitted any access gate(s), bollard, chain or other means of obstruction shall be hung to open inwards, set back and thereafter maintained a minimum distance of 8 metres from the near channel edge of the adjacent carriageway. Any sidewalls, fences or hedges adjacent to the access shall be splayed at an angle of 45 degrees from each of the (outside) gateposts to the front boundary of the site. The reason for the condition is :- To enable vehicles to safely draw off the highway before the gate(s) or obstruction is opened.
8.Prior to the first occupation of the development hereby permitted a visibility splay shall be provided in full accordance with the details indicated on the approved plan drg no.193/07. The splay shall thereafter be maintained free from any obstruction exceeding 1.05 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety.
9.Prior to the first occupation of the development hereby permitted the proposed access, on-site car and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety.
10.No development shall take place or trees shall be removed until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping. The agreed landscaping scheme shall include indications of all existing trees and hedgerows on the land, and details of any to be retained. The landscaping scheme shall include a full Arboricultural Impact Assessment which following the submission of a full landscaping scheme provides details for the protection of the trees during the course of development. The landscaping plan shall include details of all new planting and details of the reinforcement of the planting on the northern boundary. The reason for the condition is:- In the interests of the visual amenities of the locality.
11.All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever, is the sooner, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. The reason for the condition is:- In the interests of the visual amenities of the locality.
12.No development shall take place until the following information has been submitted to and approved in writing by the Local Planning Authority: (i) a full site survey showing: the datum used to calibrate the site levels levels along all site boundaries levels across the site at regular intervals floor levels of adjoining buildings (ii) full details of the proposed finished floor levels of all buildings and hard surfaces. The development shall be carried out only in accordance with the approved details. No development shall take place until full details of the finished levels, above ordnance datum, of the ground floors of the proposed buildings, in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The development shall be carried out in strict accordance with the levels approved. The reason for the condtions is:- To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site.
13.Prior to the commencement of the development hereby approved details of the boundary treatments shall be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details. The reason for the condition is :- In the interests of visual amenity.
14.No development shall take place until a mitigation strategy detailing the protection of the Great Crested Newts during the construction is submitted to and approved by the Local Planning Authority. The strategy shall also include details of enhancement measures for the Newt habitat. The development shall be carried out in accordance with the approved details. The reason for the condition is :- In the interests of supporting and enhancing biodiversity.
15.No development shall take place until details of the siting of bat boxes have been agreed in writing with the Local Planning Authority. The boxes, as agreed, shall be installed prior to the commencement of any development. The reason for the condition is :- To provide nesting sites for bats in accordance with the protected species assessment.
16.No development shall take place until a full surface water strategy is submitted to and approved by the Local Planning Authority. The strategy shall show how the surface water is accommodated within the site and shall not create a flood risk to either the occupants of the site or the surrounding properties. In addition the surface water strategy shall ensure that no mitigation measures will be detrimental to Great Crested Newt populations found within the site. The development shall be carried out in accordance with the approved details. The reason for the condition is :- In the interests of ensuring water is adequately drained and does pose an environmental risk.
17.Notwithstanding the approved plans the windows in the northern elevation of the new build dwellings hereby approved shall be obscure glazed and non-opening and shall remain so in perpetuity. The reason for the condition is :- In the interest of neighbouring privacy.
18.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) no windows shall be added to the northern elevation above ground floor level of the new build dwellings hereby approved without the consent of the local planning authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity.
19.Construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:00 to 13:00 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
20.Prior to the commencement of the development and to the satisfaction of the Environmental Services Group Manager, a Phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a Phase 2 site investigation is to be carried out to the satisfaction of the Environmental Services Group Manager. If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed end-use to the Environmental Services Group Manager. No buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
21.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
22.Notwithstanding the approved plans no work shall commence until the exact types and colours of the materials used in the external elevations of the barn conversion have been submitted to and approved by the Local Planning Authority. The development shall be carried out using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
23.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) the converted barn shall not be extended in any way nor shall any windows be inserted without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of visual amenity.
24.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in saved policy HOU17 of the Borough Wide Local Plan and policies CS2, CS3 and CS9 of the adopted Core Strategy.
25.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.

27.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management and Operations team on 0344 800 8020. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
