| 1. | By virtue of the proposed development requiring the felling of TPO trees T7( Monterey Pine) and T2 (Scots Pine), and not allowing for the adequate replacement of T6 (Scots Pine failed replacement tree following unauthorised felling) the scheme is considered by the Local Planning Authority to have a significantly harmful impact upon the visual amenity of the site and would be contrary to adopted policy CS9 (parts b and g) of the Great Yarmouth Local Plan - Core Strategy 2015. |
| 2. | By virtue of the excessive number of dwellings proposed in this backland location the applicant has not satisfied the Local Planning Authority that the site can be developed without adversely impacting the character of the area and amenity of neighbours. The proposal is considered to be over-development of the site which would result in a cramped development, loss of protected trees, and harm the amenity of neighbouring residents, and would be out of character with the existing settlement form and street scene. As such the scheme is considered to be contrary to saved policy HOU7 and HOU17 of the Great Yarmouth Borough Wide Local Plan 2001, and adopted policy CS9 of the Great Yarmouth Local Plan - Core Strategy 2015. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
