1.Application for approval of reserved matters must be made not later than the expiration of three years beginning with the date of this permission and the development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. The reason for this condition:- The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the revised plan (17/127 - 05) received by the Local Planning Authority on 30.10.2017. The reason for the condition is :- For the avoidance of doubt.
3.No development whatsoever shall take place until full details of the appearance and landscaping of the development (herein after referred to as the reserved matters) have been submitted to and approved by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details. The reason for the condition is:- Such details have not been submitted as part of this application.
4.No dwelling shall be occupied until the Traffic Regulation Order for the prohibition of driving on the U6V106 Palgrave Road Back Lane has been made by the Highway Authority. The reason for the condition is :- In the interests of highway safety.
5.Prior to the commencement of any works details of demolition and construction traffic access, waste removal and building material storage which shall incorporate adequate provision to maintain safe pedestrian access to Palgrave Road Back Lane shall be submitted in writing for the written agreement of the Local Planning Authority. The reason for the condition is :- In the interests of maintaining highway safety and to protect the amenity of neighbouring residents.
6.For the duration of the construction period all traffic associated with the construction of the development will comply with the details as agreed with the local Planning Authority in relation to condition 5 of this permission. The reason for the condition is :- In the interests of maintaining highway safety and to protect the amenity of neighbouring residents.
7.Prior to the commencement of development a scheme of compensatory features such as fire suppression sprinklers shall be submitted to, approved in writing by the Local Planning Authority in consultation with Norfolk Fire and Rescue and Building Control, and implemented in all dwellings. The scheme shall thereafter be maintained in perpetuity. The reason for the condition is :- To ensure that whilst the site does not have access for a fire appliance compensatory measures are incorporated into the development.
8.Prior to the commencement of the development and to the satisfaction of the Environmental Services Group Manager, a Phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a Phase 2 site investigation is to be carried out to the satisfaction of the Environmental Services Group Manager. If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed end-use to the Environmental Services Group Manager. No buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
9.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
10.During construction of the dwellings hereby approved the following measures shall be employed:- - An adequate supply of water shall be available for suppressing dust - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site. The reason for the condition is :- To protect the amenity of neighbouring residents during the construction phase.
11.Prior to the commencement of the development, a flood response plan shall be submitted to and agreed in writing with the Local Planning Authority. This flood response plan, including information regarding the availability of the Environment Agency's Flood Warnings Service, shall be made available to future occupiers of the site. The reason for the condition is :- In accordance with the recommendations of the flood risk assessment, to minimise the risk to the occupants in the event of flooding.
12.The development hereby permitted shall be carried out incorporating the measures to mitigate the risk from flooding set out in the Flood Risk Assessment completed by Evans Rivers and Coastal (ref.1771/RE/02-17/01) of 21st February 2017 The reason for the condition is :- To ensure that mitigation measures are undertaken as the property is located within an area at risk of flooding.
13.Construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
14.No part of the proposed structure (to include fascia board / rainwater goods and guttering) shall overhang or encroach upon highway land and no gate / door / ground floor window if installed shall open outwards over the highway. The reason for the condition is :- In the interests of highway safety.
15.REASON FOR APPROVAL OF THE APPLICATION :- The proposals meet the criteria for new housing development set out in saved Policy HOU7 of the Great Yarmouth Borough-Wide Local Plan.
16.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
