No.Condition Text
.The application is to create an annexe; however the proposal is considered to create a new dwelling. The proposal represents a separate planning unit as it does not share a curtilage or access to the site. The site is completely separate from the main dwelling and contains all facilities required for self-contained living.
.All physical alterations should relate acceptably to its surroundings in terms of the character of the area and the neighbouring properties. The proposal is considered to significantly and adversely affect the amenities of the neighbouring properties in terms of its overlooking and loss of privacy. The imposition upon the neighbouring properties and uses is considered such that it creates an unacceptable development. In accordance with policy CS1 of the Core Strategy these adverse impacts do not outweigh any benefits.
.The proposal is also considered unsympathetic to the character of the area in terms of its scale and form meaning it is contrary to policy CS9 of the adopted Core Strategy in that it does not adequately comply with criterion A in drawing inspiration from the surrounding built environment. In addition the unit is not considered to have a sufficient sized curtilage particularly when compared to the other properties on California Crescent. The absence of a northern elevation plan has meant that the applicant has not sufficiently shown that the northern elevation will not significantly and adversely affect the character of the area.
.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
