1.Notwithstanding the submitted application form no development whatsoever shall take place until full details of the Appearance, Landscaping, Layout and Scale of the development (herein after referred to as the reserved matters) have been submitted to and approved by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details. The reason for the condition is:- Such details have not been submitted as part of this application.
2.Application for approval of reserved matters must be made not later than the expiration of two years beginning with the date of this permission and the development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. The reason for this condition:- The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
3.The access into the site shall be carried out in accordance with the approved plan received by the Local Planning Authority on 18 January 2017. The reason for the condition is :- For the avoidance of doubt.
4.The details to be submitted in respect of condition No. 1 shall include a plan indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed before the dwellings hereby permitted are first occupied or in accordance with a timetable agreed in writing with the Local Planning Authority. Development shall be carried out in accordance with the approved details. The reason for the condition is :- In the interests of the residential amenities of both the occupiers of adjacent property and the future occupants of the dwellings hereby permitted, and in the interests of the visual amenities of the locality.
5.In accordance with condition 1 no development shall take place and no trees shall be removed until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping, which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained. The landscaping scheme shall also include an Arboricultural Impact Assessment which provides details for the protection of the trees during the course of development. The development shall be in accordance with the approved details. No trees shall be felled or removed from the site unless in accordance with the approved landscaping scheme. The reason for the condition is:- In the interests of the visual amenities of the locality.
6.All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever, is the sooner, and any trees or plants which within a period of 5 years from the occupation of the final unit die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. The reason for the condition is:- In the interests of the visual amenities of the locality.
7.Notwithstanding the approved application form no development shall take place until the full details of the internal road layout is submitted to and approved by the Local Planning Authority in consultation with the Highway Authority. The full details shall include details of hard surfaces, vehicular turning and manoeuvring, access to properties, drainage, parking and visibility splays. The development shall be carried out in accordance with the approved details prior to the occupation of the first unit. The access roads shall remain in perpetuity and free from obstruction. The reason for the condition is :- In the interests of ensuring the roads are built to an acceptable standard and to ensure the retention of important trees.
8.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Monday to Friday 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.No development shall take place until the following information has been submitted to and approved in writing by the Local Planning Authority: (i) a full site survey showing: the datum used to calibrate the site levels levels along all site boundaries levels across the site at regular intervals floor levels of adjoining buildings (ii) full details of the proposed finished floor levels of all buildings and hard surfaces. The development shall be carried out only in accordance with the approved details. No development shall take place until full details of the finished levels, above ordnance datum, of the ground floor(s) of the proposed building(s), in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The development shall be carried out in strict accordance with the levels approved. The reason for the condtions is:- To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site.
10.No development shall take place until a scheme of surface water management has been submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details. The surface water management measures shall be completed prior to the occupation of the first unit. The reason for the condition is :- To ensure the adequate disposal of surface water.
11.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined under policies HOU7 and HOU17 of the Borough Wide Local Plan (2001) and policies CS2 and CS3 of the adopted Core Strategy.
12.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
