| 1. | Paragraph 17 of the National Planning Policy Framework requires all developments to create a good standard of amenity for all existing and future occupiers of the site. The proposed ground floor flat is not considered acceptable in terms of its size and layout. The flat is significantly undersized resulting in an unhealthy living environment for the occupiers and a poor standard of amenity. In addition it contrary to the aims of criterion E of saved policy HOU7 of the Borough Wide Local Plan (2001) which aims to avoid detrimental impacts to the users of the land. The proposal is also considered contrary to criterion C of policy CS9 of the adopted Core Strategy and criterion A of saved policy HOU7 of the Borough Wide Local Plan (2001) in terms of the proposals impact upon the visual amenity of the area. The proposal does not provide adequate bin storage and the intensification of use would result on bins being stored in a visually apparent location resulting in a degradation of the visual amenity. Consequently the application has been refused as being contrary the environment standards of paragraph 17 of the National Planning Policy Framework and policies CS9 of the adopted Core Strategy and saved policy HOU7 of the Borough Wide Local Plan (2001) |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
