| 1. | Criterion E of saved policy HOU7 of the Borough Wide Local Plan (2001) states that a new dwelling should not be significantly detrimental to residential amenities of the users of the land. In this instance the occupiers of the proposed dwelling will be situated within an area of active employment and commercial uses where it will be subject to high levels of noise and disturbance. The application has not sufficiently shown that the noise and disturbance affecting the property has been mitigated against and that the occupiers will have a good standard of residential amenity. In addition criterion B of the policy CS6 of the adopted Core Strategy states that within employment areas the appicant should demonstrate a satisfactory relationship between the proposed use and any pre-existing neighbouring uses as well as the unviability of the employment use. This is further supported by paragraph 17 of the National Planning Policy Framework which always seeks to secure high quality design and a good standard of amenity for all existing and future occupants of land and buildings. Consequently the application has been refused as it does not conform to saved policy HOU7 of the Borough Wide Local Plan, policy SC6 of the adopted Core Stratgey and paragraph 17 of the National Planning Policy Framework. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
