| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the revised plan received by the Local Planning Authority on 17/02/2017 (DRG.no 1162/2 rev-A).
The reason for the condition is :-
For the avoidance of doubt. |
| 3. | No work shall commence until the exact type, colour, texture of stonework, and detailed design drawings (including a section) of the proposed masonary work relating to the alteration of the windows including a matching trim detail, have been submitted to and approved by the Local Planning Authority. The development shall be carried out using the agreed material, design and specification.
The reason for the condition is :-
In the interests of the visual amenities of the area as precise details of the materials have not been submitted. |
| 4. | The dwellings shall not be occupied until the bin (and cycle) storage area shown on the submitted plan 1162/2 rev.A has been set aside for this use for flats 1,2,and 3, in accordance with the approved plan and those areas shall not be used thereafter for any purpose other than the storage of bins or cycles associated with the dwellings.
The reason for the condition is:-
In order to ensure the provision of proper bin and cycle storage in the interests of highway safety and visual amenity. |
| 5. | Notwithstanding the details and annotations included in the revised drawing (DRG.no 1162/2 rev.A) full details of external alterations, removal or replacement to any windows, doors or other openings shall be submitted to, and approved in writing by the Local Planning Authority . Details to be submitted shall include elevational and sectional drawings at 1:5, details of materials to be used in the windows or doors, and where required samples of proposed materials. The details approved in writing by the LPA shall retain thereafter.

To ensure the character and appearance of the building and conservation area are preserved. |
| 6. | The developer must undertake a BS4142 survey (2014), Method for Rating Industrial Noise Affecting Mixed Residential and Industrial Areas which would assess likelihood of complaints and suggest additional measures for noise mitigation. The developer should then undertake any recommendations which result from the survey.
The reason for the condition is :-
Due to the possibility of various use classes being located at ground floor level and residential above mitigation may be required which should be addressed through a noise survey in the interests of residential amenity. |
| 7. | The Developer needs to submit a scheme and specification detailing how noise insulation between the business and the domestic premises above will reduce the potential of noise complaint to a minimal level. The scheme needs to be implemented before the business opens.

Due to the possibility of various use classes being located at ground floor level and residential above mitigation may be required in the interests of residential amenity. |
| 8. | The following hours of opening should be adhered to: Monday to Sunday 09.00am - 11.00pm

| 9. | Any flue installation and odour control equipment required must be maintained and cleaned at intervals required by the manufacturers of the equipment. The manufacturers maintenance and cleaning schedule to be submitted to the Local Planning Authority before the system is brought into use.
The reason for the condition is :-
In the interest of neighbouring residents amenity. |
| 10. | The design of any flue duct or extraction system must be such that there is access to all parts of the installation for cleaning and maintenance. Any access panel must have the same acoustic properties of the duct. A specification for the extract ventilation system detailing how compliance with this condition will be achieved must be submitted to the Local Planning Authority prior to commencement of the works.

| 11. | Prior to the commencement of an A3, A4, or A5 use in consultation with the Council's Environmental Health Department the applicant shall submit details of a flue and odour extraction system in writing to the local planning authority. The use or occupation shall not commence in any part of the building until written confirmation has been recieved from the Local Planning Authority that the proposed details are acceptable, and the extraction system as approved has been installed.
The reason for the condition is :-
To ensure adequate odour extraction systems are in place where required to protect the amenity of future residents. |
| 12. | No gate / door / ground floor window if installed shall open outwards over the highway.
The reason for the condition is :-
In the interests of highway safety. |
| 13. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria of saved policy HOU23 and SHP4 of the Great Yarmouth Borough Wide Local Plan. |
| 14. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
